Thank you so much for your reply. We tried calling several phone numbers with no success- for instance the phone number provided by USCIS CSC is a wrong number.
Our attorney has always seemed reluctant to contact them.

No salary/ paying everything out of pocket including healthcare for 3 months, but also will have to take risky travel with a toddler to home country where Covid cases are at peak, if this does not resolve by the end of October.

I am not much different than you, but you may think of sending them an email to expedite to process due to urgent humanitarian need. And perhaps ask help from the attorney to write it. Or might as well you can give a shot.

J1 waiver based on hardship to USC

    My timeline:

    USCIS application date May 16,2019

    RFE January,2020

    Response to RFE April 2,2020

USCIS sent i612/613 to DOS April 17,2020

DOS website update as received June 17,2020

When should be considered as the DOS processing time start Date? Their website states 16-24 weeks as processing time, I am on 24 weeks mark this week if April 17th-USCIS sent date is considered the start.

ds2019 expired already- got extension for exam which is expiring at the end of October.

    Any suggestions / advise?

Several inquiries by congressman office and by myself

Are you able to call them? And did you also try reaching them out with your attorney?

Wow! This very good news for you. You are right, your case transferred to the DOS

Hopefully the DOS will start working on your case soon

When your case status changed to on hold? because we have almost same timeline

USCIS is still reviewing my case and there is no movement yet

Honestly, I am a bit worried. I filed SR back in July and the response I got was that the case is being adjudicated and should receive notice of action within 60 days. However, there isn't any updates yet. By mid of September, the 60 days period will end

I am planning to raise a new SR. It has a been more than a year since I first filed my case. Waiting is really painful

Can you do me a favor, would you please log into your account in the DOS website the waiver section and let me know when the last time the status was updated

Mine was last updated August 28th. Is the same date visible for your case

I hope so thank you and yes use every option and maybe they update it by then. They put on hold recently on August 30. But there is no update from DOS and I have the same status last updated in DOS page. I think its due to their system.

    Not yet!

After the RFE response was delivered to the USCIS, there is no movement

I have one more question, when your RFE was issued and when your RFE response was received, did your status on the USCIS case status tool was updated in both cases?

I am asking because in my case, the status is always "your case has been received"

I knew about the RFE when I received it by mail and regarding the RFE response, I had to call the customer service number to confirm with the agent that the USCIS received my response and entered that into the system. it seems in my case that I can't rely on the case status tool for some reason

Yes both updated in the system. But nothing since then. The DOS part is gonna be another mystery but hopefully everything gets faster.

Honestly, the point of the processing time is vaid

However, in the received RFE note, it is stated that if the USCIS didn't make a decision within 60 days, the applicant should call the customer service number

I think you can try to call the customer service again and argue that, per the RFE note, more than 60 days has passed since the USCIS received your response to the RFE and this should make you able to raise SR

    It says

    Quote

If you have not heard from USCIS within 60 days of responding, you may contact the customer service

So the sentence is a little vague and they updated the status to the response to RFE was received. So they would probably argue that they responded but yet to take an action. I previously called the customer service and they said the processing time is November now and as I filed in December, I will probably be hearing from them within a month or so.

I will call them again with the 60-days responding argument. Did they send yours to DOS yet?

    Hello J1Issues,

We have similar timeline. I filed for J hardship based waiver late August 2019, got RFE on March and responded May 2020 and still no movement

Did you try raising a service request (SR)? if yes, what was the USCIS response to the SR?

    Hello,

I called the customer service and they told me the current proccessing time is November and mine is December. But It was 4-6 months until a couple of weeks ago. So when I try to do a e-request, I receive the line below:

Your application or petition is currently within the posted processing times. An inquiry may not be created at this time. Further information about recent processing times can be viewed on the uscis.gov webpage.

I am not sure what other options would be a good to use.
