  1. Hello all, I contacted my senator regarding my i485 which was denied because of I didn’t properly file i601 waiver, and filed I i290b motion to reconsider with a properly filed i601 waiver. And this is the response, what should I do? « Thank you for your inquiry, dated October 25, 2024 on behalf of your constituent, ****my name***, regarding their pending form I-485 Permanent Residence/Adjust Status (Family). U.S. Citizenship and Immigration Services (USCIS) records indicate that ****my name****case is pending at this time. USCIS is committed to adjudicating immigration benefits in a timely, fair, and efficient manner while also ensuring public safety, national security, and compliance with all relevant laws, regulations, and policies. While the processing steps for most applications or petitions are completed quickly, a small percentage of cases involve unresolved issues that may result in adjudication delays. For example, if our review reveals one or more questions that may impact an individual’s eligibility for a particular immigration benefit, further inquiry may be needed. The inquiry may include an additional interview, contact with another agency for updates or more comprehensive information, or some other action. We are unable to determine at this time when the review process for the Form I-485 Permanent Residence/Adjust Status (Family) will be completed.   2. Yes I was in removal, yes pending I130 and filed i360 while i130 was pending. Then i130 denied for fraud, received NOID on i360 and submitted a bunch of proofs to justify the fraud and got i360 approved. Anyway you are free to do what you think is right. Here we are Sharing experiences and advice, not legal advice. Talk to your lawyer, however many lawyer don’t know these things we share here. My i485 got denied because the lawyer failed to properly submit i601 waiver
  3. @Demiseis right, I did c9 ead too based on pending i485. My i485 was denied and filed i290b and after that I filed C9 ead and got it 3 days ago valid for 5 years. I do have another c31 renewal based on approved i360
  4. @Demise is right. I just got my 5 years EAD (C9) based on pending i485 and I got another C31 (2 years based on approved vawa).

  6. The i601 is stuck on case was received. The i485 status is showing case was transferred to another office having jurisdiction over your case since January 2024 and I received a letter from uscis Vermont confirming the transfer (I guess it went from local office to Vermont). when I made a request of « outside normal processing time» 3 months ago, received an email from the local office saying « decision will be made within 90 days». The 90 days expired with nothing from them. I made another request last week, received an email that my case went to AAO since April 27,2023 when they received my I290 April 14 2023. very confusing as you stated, how the local office telling me that my case went to AAO April 27 2023 when in January 2024 case was transferred to Vermont?

Is it a good idea to sue USCIS or file an expedite request for my i485? my i485 was denied, I filed i290b motion to reconsider April 2023, after I got RFE for I601 waiver that I submitted July 2023. looks like the I485 was reopened because I got C09 EAD after that and my I485 status says it was transferred to another office since January 2024(from local office to Vermont office ).
  8. Hello guys. My i485 was denied because my lawyer didn’t properly submitted i601 waiver. We filed i290b motion to reconsider and received RFE of i601 waiver again. This time we file i601 waiver with the right office. i was expecting myi485 to be approved since we gave them i601 waiver they asked for. Now received that my case was sent to AAO office. I’m just exhausted with this case and don’t know what to do « Type of service requested: -- Outside Normal Processing Times The status of this service request is: Thank you for your inquiry, dated September 23, 2024, regarding your Form I-290B, Notice of Appeal or Motion, filed after the denial of Form 1-485 Application to Register Permanent Residence or Adjust Status. We have confirmed that the appeal is currently pending adjudication with the Administrative Appeals Office (AAO). The AAO received the appeal on Form 1-290B on April 27, 2023. The AAO strives to complete its appellate review within 180 days from the time it receives a complete case record after the initial field review. Some cases may take longer than 180 days due to factors beyond the AAOs control. For example, additional documentation may be needed to complete the record, or the case may be more complex and require additional review. Be assured the AAO will adjudicate the appeal as quickly as possible giving the case full and fair consideration, consistent with all applicable laws, rules, and regulations. Once a decision is made, you will be notified.»
  9. Hello guys, I called USCIS to file an outside of normal processing time request for my pending i290B motion to reconsider for my denied I485. My local office responded that they’ll make a decision for this case in 90 days since June 25th, in exactly 13 days the 90 day period will expire. Should I call USCIS again now to remind them that the 90 day period is expiring in 2 weeks without a decision or I wait until the last day and make another enquiry? If I make another enquiry , uscis will tell me to wait another 90 day again.

  11. Does it mean if you enter the US 10 years ago and you are issued your green card today you can file citizenship right away? In this case your entry date was 10 years ago
  12. I filed my outside normal processing time based on i290b. The online status showed like yours and USCIS sent me an email that I should expect a decision on my case within 3 months. That if I don’t receive a decision in 3 months I must contact the USCIS number again . Hope you received a decision
