Forgot to remind you in my reply above that since part of your year was in the UK, that income qualifies for the foreign earned exclusion. So even though you are reporting all of it, the part while residing in the UK isn’t taxed.by the US. It gets subtracted out on Schedule 1

Going to do some cut/paste for you as I find things
    ————————-

Get off your foreign tax role when you move to the US. You pay tax to the country where your reside no matter the employer or where you earn or where deposited. Your employer should get an Employer Identification Number (EIN) from the IRS and withhold US tax, Medicare, and Social Security from your pay and submit online to the IRS each paycheck. At the end of the tax year he will issue you a W2 wage statement for doing your US taxes.

Or he can treat you as a self-employed contractor and thus not have to hold anything out of your check. He would still get an EIN so he can issue you a 1099 wage statement at the end of the year.  You would  be responsible for paying in your own tax, Medicare, and Social Security with Quarterly Estimated Tax Payments.
    —————————————

    International EIN Applicants
If you have no principal place of business, office or agency, or legal residence in the United States or U.S. Territories, you're considered an international applicant, and you can only apply for an EIN as follows:
By Telephone - If you're an international applicant, you may call 267-941-1099 (not a toll-free number) 6 a.m. to 11 p.m. (Eastern time) Monday through Friday to obtain an EIN. You must be authorized to receive the EIN and answer questions concerning the Form SS-4, Application for Employer Identification Number PDF. When applying by telephone, it's helpful to complete the Form SS-4 before contacting the IRS. An IRS representative will use the information from the Form SS-4 to establish your account and assign you an EIN.
By Fax or Mail - You can apply by fax or mail as indicated above.
    —————————-

Yes. The easiest option for the employer is #2 because he does not have to send money to the IRS each paycheck or pay a service to handle that task for him. My wife somehow accidentally ended up talking to a lady at IRS that issues EINs to foreign employers. She said it’s real easy. They just call up, give some info, and get assigned a number. Then the employer issues a 1099 to you saying how much total they paid you between Jan 1 and Dec 31. Here’s what a 1099 looks like. Most of the boxes he wouldn’t fill in. https://www.irs.gov/pub/irs-pdf/f1099msc.pdf
The left side is for His business name, address, etc and your name, address, etc. And his EIN number and your SSN. On the right side it would just be something like
Box 3. $20,123.45   Box 4. $0.00 and done because the rest of the boxes are not about wages.

If this is a UK company, I know there is a code that payroll can submit to HMRC meaning you are not taxed and no NI either. I can’t help much more because I haven’t any experience with it. He sends you the full pay with no deductions, and being wise, you will set some of each check aside for when you pay quarterly to the IRS. It’s four times a year and you just estimate what to send.It doesn’t have to be exact. The IRS just wants a bit of money coming in regularly rather than you owing a bunch at tax filing time. If you send too much, it comes back as your tax refund.

On a tax return, worldwide income is no different than US income really. It’s all income and goes in the same place on a tax return. It simply income and they don’t care where it came from or if it was paid into a UK bank account.

The 2021 tax year will be the more complicated return because you’re part UK resident and part US resident. You report everything you earn on your tax return, BUT the part you earned while resident In the UK (Jan & Feb), you can take a Foreign Earned Income Exclusion (Form 2555 added to your tax return.) Since you earned it while living abroad and paid taxes on it already, your US return calculates how much the US tax would have been for the 2 months and subtracts that from your total tax. TurboTax handled it for me my first year. You can also go to an accountant.

As far as no EIN or 1099. 🤷‍♂️ Dunno. You still report how much you earned.  I have somebody who is supposed to give me a 1099 as a contractor. He hasn’t for two years. We still report how much he paid me.

I would avoid the rapid as they're not supposed to be as reliable. Swab test sounds more legit to me. When I did a PCR tear recently for travel it was done with a swab.

Have never heard of the "fit to fly" thing. If the US does not require that I would skip it.

DQd 30th June - interview on the 6th of October! Also scheduled my medical, she said they've just released 400 interviews so they are struggling with capacity.....but she's made it the same day as my interview!

Also the covid vaccine is required she made clear - both doses.

Go to the interview as scheduled, they hold off on issuing a visa until the medical is received.  This is not an uncommon occurrence.

Sounds like our timeline and situation is very similar to yours.

Remember that those people who are finishing the process now have different timelines from the people who were finishing the process 18 months ago. It's really hard to predict what our timeline will be. We're trying not to get too excited by a few profiles of people who have sped through the process in 9 months, and instead prepare for at least 18 months. Anything shorter is a bonus.

They will always take your fingerprints. That’s normal. Being taken into secondary and having your bags searched etc is not normal. That happened to me once. But only once.

Every single entry was straightforward except one. Las Vegas airport. Awful experience one time although I went through CBP at Las Vegas several times with no issue at all. I just think the officer was having a bad day.

I was only asked about it once but it was just a quick “what stage of the process are you at?” and when I told him that we were still waiting for the I-130 to be approved (which we were) he smiled and stamped my passport and I was on my way.

If eligible for VWP, submit ESTA application if you haven't already done so. Then follow the embassy's recommendations: https://uk.usembassy.gov/visas/u-s-visa-and-travel-faqs/
If you travel, please follow the steps below:
Do not attempt to check in for your flight online if you have an ESTA registration. Arrive early for your flight. Carry as many original documents as you have available that you believe demonstrate why you have been excepted from a travel restriction, such as a Permanent Resident Card (commonly known as a Green Card), a marriage certificate, or a birth certificate. We are unable to provide guidance about your documents or whether copies will be considered sufficient as such questions are a matter for CBP when you travel. You may also wish to carry a printed copy of the Presidential Proclamation itself. Your status will be reviewed in consultation with U.S. Customs and Border Protection (CBP) officials. Please note that smaller airports may not have CBP officials on site. If applicable in your case, your ESTA will be reinstated in order to allow you to board.
Do I need a negative COVID test result to travel to the United States?
Travelers from the United Kingdom must test negative for the coronavirus no more than three days before boarding flights bound for the United States. For more information on testing requirements please see the Centers for Disease Control and Prevention’s website.

Allow about 18 months for the whole process to be complete. You won’t hear anything for many months after Nebraska receives the petition. Assuming everything is in order with your petition, the next thing you will receive is the petition approval, many months down the line. Use this waiting time wisely to gather documents needed for the NVC stage of the process, in particular your long-form birth certificate from GRO (assuming you were born in the UK), and divorce or death certificates from any previous marriages either of you have had.

Ignore anything you see about not being able to visit. I visited on the VWP over 40 times, including several times during my visa application period. Each visitor entry is at the discretion of the CBP officer on duty when you arrive at the border but merely having an immigrant visa application in the works is not a reason to be denied entry.
