  1. A lot of that has to do with the overall immigration trends for Kuwaiti citizens who are not known to use a B2 to come to the US and overstay. This is also demonstrated by visa refusal statistics for B visas posted by the US department of state. Kuwait had only 16% refusal rate, you can compare to my home country Kazakhstan which had a 44% refusal rate. https://travel.state.gov/content/dam/visas/Statistics/Non-Immigrant-Statistics/RefusalRates/FY22.pdf that explains why for your relatives strong ties weren’t AS central to their approval as it was to my parents or other relatives and friends I have. And this goes beyond just my country, but majority as you can see from statistics. This has to do with more that personal circumstances as you mentioned.

  5. Back in the student days, my parents applied for a tourist visa to come see me at the graduation. No invitation letters involved, I didn’t write anything nor provide any proof of studies.They applied on their own merits like was mentioned above. They did and still do have very strong ties to the country of origin.

  9. Yes ACA Obamacare, that’s what I was on when I arrived as a K1 and I got it after we married and before I even applied for AOS. No issues, we received tax credits which lowered the premium significantly (they look at total household income to see how much tax credit you can receive).

  11. With a very strong immigrant intent that is demonstrated by: a) previous overstay b) previous immigrant petition the likelihood of receiving a B2 is practically zero.
  12. What application? There’s a window after marriage or after arrival in the US in which your spouse can ask HR to add spouse to the insurance. If that mark has passed, then you will have to wait for the next enrollment period.
  13. This should have been escalated in the HR department as that IS a Qualifying life event. Next best option is ACA plan (Obamacare) through a market place.

This has happened many time to many people and this is not the end of the world. Her status is and will remain the same - Lawful Permanent Resident (LPR). She’s just waiting for the evidence of that to come through. File I-90 with a fee waived and get the stamp. If it expires, get another one. I-551 stamps ARE evidence of LPR status while she waits for the plastic card.

So if you don’t want to delay your case, I suggest bringing it with you to have it readily available should they ask for it.
