After what seems like forever (initial submission of I-129F in May 2020), we have finally received one of the notices for our AOS interview. I do have some questions and I apologize in advance if these are asked daily. I tried going through the stickies, but my questions remained.
I was hoping the AOS interview notice would contain specific info for our case, but it was just a generic letter with the terms "if required". Any help/assistance with the below questions would be greatly appreciated.
1. K1 and K2 filed their AOS, EAD, and AP all at the same time. They both received almost identical case status updates for AOS (biometrics scheduling, "actively reviewing", etc), but only the K1 has received a notice of an interview. Should we bring the K2 to the K1's interview?
We never received any RFEs for either the K1 or K2's submissions (AOS, EAD, AP). However, both of their DS-3025's have the following checkbox in section 2 selected... "K Visa applicant electing not to be vaccinated at this examination". Both the K1 and K2 were either waived or met most of the requirements and we decided to complete the remainder of the vaccines once they got stateside. They have either completed or will complete the vaccines prior to their interviews.
2. The Civil Surgeon's office I called did not initially want to perform just a vaccination update. The I-693 instructions state that only parts 1-5, 7, and 10 need to be filled out. I was able to talk them into just completing parts 1-5, 7, and 10 for our upcoming appointment. Will there be issues if sections 6, 8, and 9 are left blank in the sealed I-693 paperwork? Is there another form, similar to the DS-3025, that they should be filling out instead?
3. The K2's interview notice hasn't arrived yet so I'm hesitant to schedule her appointment since the sealed I-693 expires after 60 days. I would rather schedule her appointment once we receive an interview notice than send in the paperwork in case it gets mishandled. Is this the recommended course of action?
I submitted an I-864 with the AOS packages.
4. Would we have received an RFE if the I-864 wasn't accepted? I don't know if I should bring another form or not.
5. Is it recommended/necessary to bring recent pay stubs and employment verification to the interview?
Another line item in items to bring with you to the interview is "Birth Certificates for all children of this marriage, and custody papers for your children and for your spouse's children not living with you".
6. My spouse has 3 children. We have birth certificates for all 3, but only one of them immigrated to the US. One child is no longer a minor, and there is no formal custody paperwork for the remaining child. Will this be an issue?
For the supporting evidence of a relationship, we have a joint bank account (not really used since my spouse doesn't have an income - no EAD yet), we are on the same homeowner/car insurance policy, both K1 and K2 are listed under my health insurance, they are authorized users on some of my credit cards, and we have lots of photos that we have taken together as well as flight records of trips taken together.
7. I know a joint tax return is a recommended document to bring to the interview. However, my tax advisor has informed me that I will likely have to file an extension this year. Will this be an issue or will the joint extension be sufficient evidence that shows our intent to file taxes jointly this year? Our interview is several weeks before taxes filing is due.
