I am in the US, my hope is that change of status is not affected, but who knows. It is a bad, tough time for us.

From what I read, in their case, being an H1-B physician with the VA, they have a chance at getting interviewed.

So, I have to wait for the B1 approval to apply? I had to apply for the B1 because I could not leave the country (and still can't due to covid). I have an already approved I-129 (for consular), but on top of there being no international flights to India, the consulates are closed indefinitely. Any resources/cases on how long I-539 COS are actually taking these days (Vermont) - hopefully sooner than processing times listed. Any resources/previous cases like this - please share. Like so many people these days, I am very very desperate.

My timeline:
FR from DOS: May 12th
FR sent to USCIS: May 20th
I got receipt letter from USCIS with case number: May 26th
Case approved: May 29th
Final letter from USCIS: June 3rd
No letters from DOS - I guess it doesn't matter. Maybe postal service is just having a tough time given the current situation.

Hi!
Does anyone have knowledge on whether it is possible to apply for H1B while the B1 processing is still pending? I had an already approved I-129 but could not leave the country due to covid, so I had to apply for a B1 to stay.

Thanks so much! I took your advise and reached out to the local congressman - they promptly agreed to email the waiver division. This was last week - haven't heard back from the congressman's office yet to know if they ever responded to their email but perhaps it worked!!

~14 weeks since they should have received the documents, ~9 weeks from when the status said they had received all the documents. They replied to my email a month after I emailed and ~ 1 month after that, the FR was issued.

Do you have any idea about what they mean by "Provided we have received all the required documentation"? Does it mean that the DoS has to receive some sort of documentation from other agencies/departments regarding our application and they won't be able to process without receiving that documentation? My case is now over 13 weeks and still pending.
I believe this is a standard response. I got the same some weeks before the FR was issued.

Thanks for the response. I am not looking to get a K1. Just H1B. I am not currently on H1-B - this is a new application for which the I-129 has been approved.
The marriage and AOS might work - but it might take 6 months or so to get a work permit? I was working on F1-OPT till Jan 2020. So, its already been 3.5 months I haven't been able to work - so adding another 6 months is crazy for my career. Since my employer already applied at I obtained the I-129, would this not be faster. Barring travel and closed consulate problems.

Hi,
I was working for a university under F-1 OPT and needed to switch to H1B. Then I realized I needed the J1 waiver. My University applied for H1B and I have an approved I-129 petition. However, I could do an COS because I was still waiting for my J1 waiver. I now have a favorable recommendation for the J1 waiver and my approved I-129 which indicates consular processing of H1B visa. I am still in the U.S (I applied for a B1 in the interim which has not been accepted or denied). I am wondering if anyone know if it is now possible for me to switch the H1B from consular to COS processing since the I-129 petition is already approved. And if so, how long could this take. Since most travel/consulates are closed still - would it be prudent to explore a route that does not involve my going back to my home country for the visa?
