  1. No need to submit beneficiary's birth certificate with the I-129F petition. The beneficiary's BC will be required at the K1 visa interview.
  2. Yes. The DS-260 asks if the beneficiary has children, so the answer should be "Yes" in your wife's case. It would be a lie to keep the answer as "No" at the time of the interview. So make sure to add your child's info. For the question about whether the child will be migrating to the US with the beneficiary, answer "No". US citizens do not migrate to the US, they just relocate back home.
  3. All sponsors need to have US domicile. As the petitioner, @howmuchlonger! is the primary sponsor, so she definitely needs to have evidence of US domicile. I agree with the suggestion of @Lazybones18 -- stay in Pakistan while waiting for IL, then go back to the US and get a job before her husband's visa interview.
  4. Have him get a higher paying job? Travel to Europe/Australia/other visa countries (and return on time) multiple times? Or just apply again and hope he has better luck.
  5. The CO is not required to look at any documents brought to the interview, other than the applicant's passport. The submitted DS-160 form is enough for the CO to make a decision in most cases, even before the interview. I assume that attached image is of the paper that was given to your brother, which means he was actually told of the reason his application was denied. 214(b) denial means that the CO was not convinced that he had strong enough ties to his home country to compel him to return and not remain illegally in the US. His stated purpose for wanting to visit the US is a minor matter, not significant enough to affect the CO's decision.
  6. Enter "revocation" on the VJ Search or Advanced Search feature above and it will list several threads about other members' cases involving petition revocation. What is your visa category? Also, was your petition initially filed with and approved by USCIS?
  7. Was he not given a paper that said something like "denied under INA 214(b)"? That paper would list the reason for denial.

  11. Upload the relationship evidence under the additional documents section of the Civil Documents tab.
  12. As long as you have the NVC case number and the applicant's proof of legal residence at the target country, you may send in your case transfer request. Note that the receiving consulate still has discretion whether to accept or deny your transfer request, though a denial is unlikely with proof of legal residence.

  17. The immigrant may check by logging in to their myUSCIS account, or just enter the immigrant fee payment receipt number here -- https://egov.uscis.gov/casestatus/landing.do
  18. Congratulations on the I-129F approval! Was your fiancee able to renew her Turkish residence permit? If not, and the permit clearly shows a past expiration date, NVC could deny the transfer request. Still worth sending the request anyway. If it does get denied, try requesting a transfer to Almaty instead. No proof of residence required. Seems cases for Russian beneficiaries are being moved over to that consulate little by little.
  19. US immigration does not require documents to be apostilled at any point in the process. That lawyer is incompetent or trying to scam you, or both.

  21. You posted in the Bringing Family forum, so I assume visa category is immediate relative or family-based. If so, have you paid the AOS and IV fees? Have the fees been processed? The Upload links should be enabled soon after the fees are processed.
  22. Yep. AP for CHNV beneficiaries not adjusting status requires reason for travel. Also, not free. If CHNV applicants intend to travel in and out of the US, CHNV+AP would be more expensive than B visa application.
  23. The "Submit" button will not be enabled until after you've uploaded all the basic required documents. As long as you're able to upload documents, there's no issue.
  24. *** Moved from K1 Process & Procedures to the Philippine regional forum, for country-specific input *** She is not required to bring photos when she goes to the DFA office for Philippine passport appointment. The DFA staff will take a photo of her at the office. They will instruct her on the acceptable facial expression for the passport photo (don't show teeth, make sure ears are not covered, etc). As for USCIS, wait if/until you get an RFE. Until then, don't worry about it. After your I-129F petition is approved and your fiancee schedules her SLEC medical, make sure she goes to a different photo studio for her visa photo. Have her look for a shop that is familiar with US visa requirements.
