  1. Your wife's window for filing I-485 is closing by end of March. F2A visa category retrogressed in the upcoming April visa bulletin. That means spouse of LPR will no longer be allowed to file I-130 and I-485 concurrently. Unfortunately, F2A is no longer current on the April visa bulletin. OP has a week left until I-130/I-485 concurrent filing is no longer an option.

  3. She's married until she gets a divorce. So yes, her household size on the I-864 should reflect that she's married, regardless of her tax filing status.
  4. The I-130 petition, even if approved, will not grant your wife authorization to stay in the US beyond the duration of her I-94. To be able to legally reside in the US, she would need to file I-485 (along with your I-130) to adjust status while in the US, or return to the Philippines and apply for a spouse visa at the US embassy after your I-130 is approved.

  6. It's visa fraud to use a visitor visa to enter the US with intent to stay and adjust status. Also, as mentioned above, I-485 would not be an option anyway as your son does not have an approved I-130 with PD that is current.
  7. Filing HOH is fine if she qualifies -- ie. she has a dependent (that is not you). Also, as mentioned above, the paper filing (1040 full package with all tax schedules) is acceptable for the I-864 requirements. No need to wait for the tax return to be processed.

  9. If she is a Filipina and no longer resides in Saudi Arabia, police certificate from Saudi will NOT be required. From the DOS Reciprocity page linked above, it notes an exception for non-citizens -- "Police clearances are unavailable for third country nationals who no longer reside in the Kingdom."

  11. Vaccines for COVID-19 and Hep B are also required for that age group. Hep A vaccine is not required. Note that there is a vaccine brand that is actually a combo Hep A & Hep B vaccine, so you may get vaccinated for both, depending on the brand you get.

  15. Use your naturalization certificate. Your non-US birth certificate is not proof of US citizenship, so it's not required.

  19. The visa with CBP stamp is equivalent to the plastic GC for all legal purposes during the 1 year after the date on the stamp. So no need to risk your plastic GC getting lost in the mail.

  21. It depends on the airport and how busy the CBP lines are at the time. If there are ushers, ask them where to line up together with your wife. They will likely guide you to the line that is less busy. That could be either of the USC or visitor lines.
  22. Since you already paid the MRV fee, it would be a waste to cancel. Have him proceed with the visa interview, so you can find out for sure about his chances of visiting you in the US. Just set your expectations low that he will be approved. One advice for the interview is to be truthful but concise -- as in, don't ever lie, but don't volunteer information that is not asked. Hiring a lawyer would be pointless for a B2 application.
