F2A is still current on Table B of the April visa bulletin, which is what USCIS will refer to for AOS filing, as per https://www.uscis.gov/green-card/green-card-processes-and-procedures/visa-availability-priority-dates/adjustment-of-status-filing-charts-from-the-visa-bulletin So @Lotiza may still file I-130/I-485 concurrently, at least until April 30, 2023 or until USCIS changes the AOS filing chart to Table A of the visa bulletin.

  3. The consulate will not grant the visa if there is missing paperwork from you. They will not deny or close the case IF you notify them that you still wish to pursue the visa but you are not able to proceed with the paperwork at this time. They will keep the case in temporary Refused/AP status until you are ready to proceed. Again, it is critical that you contact the consulate in writing (email is ok) at least once per year about your intent.

  5. In that case, do NOT withdraw your petition. Simply delay the submission of the requested paperwork until you are ready to move to the US. Just make sure to contact the consulate at least once a year to notify them that you are still interested in pursuing a visa for your spouse but your current circumstances prevent you from submitting the paperwork at this time. Also, ditch that immigration attorney for not explaining the option of delaying the visa issuance. Starting from scratch with a new petition would cost you more.
  6. No need to worry about any claim of US citizenship (inadvertently) made when you were below 18 years old. Very unlikely you would be held responsible for that if any are even found. Seems you've been careful about it since becoming an adult, so don't worry and just file your I-485 package.
  7. As a spouse of a USC, your overstay and unauthorized work will be forgiven by USCIS. Your biggest pitfall will be about any prior claims to US citizenship, since you mentioned that you assumed you were a USC. If there is any form or document (like school or driver's license forms) where you said you're a USC, that could screw up your chances for AOS. How did you get SSN if you had no passport or birth certificate?
  8. Your daughter will automatically become a US citizen IF she is below 18 years old at the time her mom becomes a USC. If your wife files N-400 soon after she becomes eligible, your daughter will probably be around 14 yo when she becomes a USC. So no need to worry anymore about maintaining US residency for her GC. Your daughter can already get a US passport. No need to apply for certificate of citizenship via N-600. Although, if money is not an issue, I strongly recommend applying for a CoC anyway AFTER getting a US passport. The CoC will be her strongest proof of US citizenship.

  11. Your DQ date won't change even if you upload new documents now. For peace of mind, upload the scan of the new passport only after you get your interview letter.
  12. Yes -- after a case is DQ-ed and transferred to the embassy, NVC doesn't care anymore. In my case, I uploaded my updated documents the day before my interview and it turned out fine, though I don't recommend you wait that long to upload 😄
  13. The applicants should bring the most recent tax transcripts. Make sure they are also uploaded to CEAC prior to the interview. I recommend updating and uploading the I-864 as well. New passport should also be uploaded to CEAC. The US embassy in Manila is very strict about having all required documents updated and uploaded to CEAC before the interview. Are the applicants older than 16? If so, they need recent NBI clearance. If they are over 18, they also need PSA CENOMAR. Again, upload to CEAC prior to interview. As for the updates to the DS-260, request those from the document screener at USEM before the interview with the consul officer.

  17. For part 6, items 24.a to c on form I-864, copy the Total Income figures exactly as they are listed on your tax returns/transcripts for the 3 most recent tax years. Your individual income should be listed on part 6, item 7, while your wife's income should be on item 10.

Online filing -- Get almost-immediate receipt notice You have control over how your evidence is digitally recorded Web form could be glitchy, confusing, or have incomplete instructions Paper filing -- No need to deal with the quirks of the web form No file size limit for the evidence you want to submit Could get lost in the mail or some documents could get lost at USCIS
