But regardless of the overstay period and whether the ban has been served, the overstay will be in the person's US immigration record forever and will definitely influence the consulate's decision towards denying new tourist visa applications.

  9. If you mean a B2 tourist visa, DS-160 is the application form to fill out. With her history of overstay + ban, her chances of being approved are very low. Costs only $160 to find out for sure.

  15. If you cannot provide a police certificate from China, then you will not be granted an immigrant visa. Note also that the requirement is to provide police certificates from all countries you lived in for more than a year since turning 16 years old, not just the countries you lived in the past 5 years. The DS-260 form requires all your residential addresses since age 16.

  24. I assume you changed status to F1 student? And your current I-94 still lists your status as F1 with allowed duration "D/S"? Not sure how you can be on OPT for 5 years otherwise.
