  1. Respond to the RFE with an updated I-864 from your husband, with evidence of his current income, like recent pay stubs. Also add a letter stating that you are no longer using a joint sponsor.

  7. How old are your sons? What are their case Priority Dates?
  8. Bring all the court documents about your case. As others already mentioned, only the consul office can decide if you need a waiver or not. If you want to prepare in advance for the possibility, consult with an immigration lawyer experienced with waivers for CIMT inadmissibility. But you cannot apply for a waiver ahead of the visa interview.
  9. If your wife was able to get CRBA for your 2nd child, then she would have no issue getting CRBA for your 3rd child as well. As mentioned by @ROK2USA, just provide your new baby's info on your DS-260 form after the I-130 is approved. No need to update the petition or inform USCIS. Also, for the DS-260 question about whether your USC wife/children will be immigrating with you, answer "No". USCs do not immigrate to the US (they just relocate).
  10. If your wife never submitted a DS-160, then technically, she did not apply for a K1 visa. No visa application to refuse. A petition (even if approved) is not the same as a visa application.
  11. For the I-130 petition, bona fide relationship evidence not in English must be submitted with a translated version. Also, if you have stronger evidence of time spent together in person, no need to submit chat logs. Passport stamps or boarding passes, supported by pictures together, would be better.

  18. Provide your new address on the DS-160 form. No need to update the approved I-129F.
  19. Congratulations on the I-129F approval! Once CEAC status turns "Ready", submit the DS-160 form, pay the MRV fee, then book the K1 visa interview appointment through the online portal -- https://ais.usvisa-info.com/en-gb/iv
  20. Yes, that's enough to satisfy the I-129F requirement. And for the US embassy in Manila, that's very likely enough for the K1 visa interview as well.
  21. *** Moved from Tourist Visas forum to AOS from Work/Student/Tourist Visas forum *** Here's the USCIS link for what @Mike E mentioned above -- https://www.uscis.gov/green-card/green-card-processes-and-procedures/visa-availability-priority-dates/adjustment-of-status-filing-charts-from-the-visa-bulletin LPR marriage-based AOS from tourist visa would be F2A under family-sponsored preference categories.

  24. You may need to get PSA CENOMAR even if you go through the consulate in Singapore for your CR1 visa. There's not many who report from SG about it, but there's reports here on VJ about the consulates in Hong Kong and Japan asking for CENOMAR from Filipino applicants. But it's not much of a hassle to order your CENOMAR online. Note also that it's acceptable to present a CENOMAR and not a CEMAR (Advisory on Marriage) even if you are already married. The consulate just wants to check that you were never married in the Philippines. That's what I did -- married in the US, didn't file ROM, presented a CENOMAR (not CEMAR) to the US consulate, got my spouse visa just fine. No questions asked why I didn't file ROM. That said, my non-filing of ROM was out of ignorance/negligence, not intentional. I realized too late that ROM was required for my PH passport renewal with married name. Now I'm stuck with a passport, green card, and other US IDs/accounts in my maiden name, and it would be a hassle to get my name changed on the documents before I get US citizenship. So, if you're fine with having your passport list your maiden name, then no need to file ROM with the PH consulate. But if you do want to use your married name in your PH passport, then you must file for ROM before renewing your passport. No need for a new passport for the I-130 petition. Just need one in time for the visa interview. Your spouse visa, green card, and SSN will list whatever name is in your PH passport.
