  1. *** Moved from IR1/CR1 Process & Procedures to Moving to the US forum -- topic is about POE procedures after the visa process *** Only the consulate can change the visa issued to an applicant. CBP cannot tamper with the visa, apart from putting the entry stamp on it. It doesn't matter whether CBP writes CR1 or IR1 on the stamp. It is USCIS that determines whether an LPR should get a 2-year or a 10-year green card, based on the wedding date on the marriage certificate and the date of 1st US entry. If USCIS makes a mistake, file an I-90 for free, to replace the green card.
  2. Make sure to book the tickets using her passport name. As mentioned above, have your wife bring a copy of your marriage certificate to link her passport name with her GC name. No.
  3. *** Moved from K1 Process & Procedures to K1 Progress Reports *** My advice is to fire that lawyer and to hire a more competent and trustworthy one.
  4. Country of departure matters for visa holders from the Philippines. There is a specific document (CFO sticker/certificate) required from K1/immigrant visa holders traveling out of the Philippines. CFO not required if they travel from any other country.
  5. *** Moved from K1 Progress Reports to K1 Process & Procedures *** The issuing consulate does not matter. But because your fiancee is a Filipina, her country of departure with K1 visa DOES matter. If she travels from Thailand WITHOUT stopping by the Philippines, all she will need is her passport with K1 visa. Maybe also the K1 packet, if the Bangkok consulate sent her any. If she goes back to the Philippines before traveling to the US, she will need to present a CFO sticker or unexpired certificate before she will be allowed to board the plane out of the PH with her K1 visa. Since she is an OFW, I assume she got a CFO sticker already prior to working in Thailand? If not, she must get a new sticker or certificate before her flight to the US. No CFO sticker/certificate = no boarding the plane out of the PH. Check the thread below for recent experiences re: presenting CFO on exit --

  9. Because this thread (and sub-forum) is about cases of spouse of US citizen. Topics about F2A (spouse of LPR) cases are in the sub-forum -- https://www.visajourney.com/forums/forum/112-bringing-family-members-of-permanent-residents-to-america/
  10. What visa process are you pursuing? I-864 is not submitted to USCIS if the applicant is pursuing a visa.

  14. Where do you see people advising OP not to apply? I don't see it. The other posters said the CO will decide at the interview. There would be no mention of interview if the advice is not to apply.
  15. For adult applicants up to 59 years old, only the following vaccinations are required -- Td/Tdap, MMR, Varicella, Hep B, Flu (seasonal), COVID. Details here -- https://www.cdc.gov/immigrantrefugeehealth/panel-physicians/vaccinations.html#tbl1 If you've had chickenpox before, the clinic may take your word for it and not require Varicella vaccine. Single dose of COVID vaccine (bivalent) or full series of monovalent vaccines will be required prior to the medical, but boosters not required for immigration purposes.

  18. What is the case status showing on CEAC? Assuming you've already submitted all required documents to the consulate, you may -- Seek help from your US citizen petitioner's congressperson to inquire about the status of your visa case on your behalf. Consider filing a Writ of Mandamus (WOM) lawsuit. I recommend hiring an experienced WOM lawyer, but you may also file it by yourself if you want.
