  6. TL;DR version -- We married in 2019. USC spouse filed HOH/MFS for 2019, 2020. I got SSN in Nov 2021. We e-filed MFJ for 2021 using my SSN. We paper-filed amendments for 2019, 2020 to change to MFJ and use my SSN. IRS ok with the retroactive use of my SSN, so we got our refunds.
  7. OP entered the US with ESTA, not K1 visa. As such, they were NOT eligible for SSN even with unexpired I-94. OP will only be eligible for SSN with EAD or GC.
  8. Do you mean that you have an I-551 stamp on your passport? If so, that I-551 stamp is equivalent to your plastic GC for all legal purposes, including travel, until its expiry date in Dec 2023.

  15. Please clarify -- what filing status did you use for 2020 & 2021? I assume you filed MFS, and your first statement I quoted above was a typo? We were in a similar situation to you and your wife, but for tax years 2019, 2020, 2021. Details in my thread below --

  18. The case will need to complete NVC review first before being queued for interview. Have you paid the NVC fees, uploaded all the required documents, and received the Documentarily Qualified (DQ) email and CEAC inbox message?
  19. It's the web form you filled out at NVC stage. You can't have gotten DQ at NVC without submitting the DS-260. Check your inbox or spam folder for an email from a state.gov address, with subject line "US DoS - CEAC Confirmation (MTL<case#>)". That email should have an attached PDF file of your DS-260 confirmation.

  21. I think you mean that your I-130 petition has been approved. Having an approved petition does not mean that your case has been approved for interview. You must go through NVC review first. That means submitting your I-864 which requires your tax info for the 3 most recent tax years. So you must back-file your taxes if you want your case to pass NVC stage and be queued for interview.
