  2. True. At SFO, when I still traveled with my B1/B2 visa, one time I was told to move to the USC/LPR line because the tourist line was very long. The CBP officer had no complaint, even after I said I was visiting my USC spouse. Hassle-free entry.

  4. If you are the USC petitioner, your US birth certificate is one of the options for the required proof of US citizenship. If you submitted one of the other acceptable documents like US passport, no need for US BC. Form G-325 is no longer required.

  11. How old is the daughter? If she is over 21 years old, there's no legal option for her but to leave the US before her I-94 expires.
  12. Does your husband have SSN? Did he work in the US legally? Unauthorized work does not count towards the qualifying work credits for the I-864 as it won't show up in SSA records. Also, will your husband be interviewing in Montreal? Your VJ profile indicates El Salvador as beneficiary's country, but you posted this thread in the Canada forum.

  14. FTJ is not available to the grandchild. FTJ is an option only for spouse and minor children of the principal beneficiary of a petition, not children of derivative beneficiaries. As mentioned above, the daughter must file a new I-130 petition for her 6-yo daughter. In addition, she may want to file I-131 for a re-entry permit, so she can return to the DR without losing her LPR status, to wait out her daughter's F2A process.

  17. Not fraud. The CBP officer was right that your wife should have just kept her GC. An LPR remains an LPR until an immigration judge takes away their LPR status or the LPR voluntarily surrenders it by filing I-407.

  19. Again, if you live outside Saudi Arabia, you do not need a Saudi police clearance. Also no need for any affidavit about not having the police clearance.

  23. As long as you can see the case status on CEAC, the case is not lost.
  24. I strongly recommend also filing I-765 & I-131. Submit your I-485 package ASAP while it's still free to file I-765 & I-131 with I-485. Read the AOS guide linked above. In summary, the forms you and your wife should fill out are: I-485, I-130, I-130A, I-864, I-765, I-131.
