  11. Unfortunately, regardless of your medical condition, your wife's visa case cannot be expedited if her case Priority Date (PD) is not current. PD for F2A India on the July 2023 visa bulletin is 08 Sep 2020.

Yes. A lawful permanent resident (green card holder) is eligible for Medi-Cal regardless of their date of entry if they meet all other eligibility requirements. Under current Medi-Cal policy, eligible green card holders get full scope Medi-Cal in California even if they have been in the United States for less than 5 years.

  14. Yes, my experience was within the past 2 years. ACA rules are the same for all immigrant visa entrants, whether IR5 or IR1. I'm talking about the Healthcare.gov eligibility check for immigration status before even selecting the specific ACA plan. The endorsed immigrant visa is enough for the immigration status check.
  15. No need to wait for the plastic GC. Your parents can submit a scan of their IR5 visa with CBP entry stamp. The entry stamp is important. I have first-hand experience that the endorsed visa is enough. Healthcare.gov confirmed my eligibility after I submitted a scan of my IR1 visa + CBP stamp (though I ended up not applying as my spouse was able to add me to his insurance plan from work, fortunately).

Typically, the SSN card is delivered within 2 weeks of US entry with immigrant visa. If the card doesn't arrive within 1 month, apply for SSN in person at an SSA office.
  18. I recommend sending an inquiry to NVC via their AskNVC form. Ask if they already received your approved petition. Provide your I-130 receipt number and attach a copy of your NOA2 approval notice PDF.
  19. Whether it's better or not depends on your and your mom's circumstances. Would your mom be fine with being stuck in the US while waiting for AP travel permit or green card? It could take many months, maybe even a year or more, before she can travel freely. If she intends to leave the US as planned in July, then I-485 would not apply to her. After you file an I-130 for her, she should pursue consular processing outside the US for an IR5 visa.

  23. Good catch. N-600K would be the appropriate path if mother and child permanently reside outside the US.
  24. From my experience, USEM typically responds to inquiries sent via their public form within 1 to 2 weeks.
