  5. I assume you're the US citizen would-be-petitioner. If you have a criminal record (even if expunged), it's true that it would be better to marry then pursue a spouse visa for your beneficiary as the I-130 petition does not require disclosure of your criminal background. But if you insist on pursuing K1, the I-129F instructions say to "submit certified copies of all court and police records showing the charges and disposition for every arrest or conviction." -- https://www.uscis.gov/sites/default/files/document/forms/i-129finstr.pdf

  8. I recommend you file the I-130 ASAP, whether or not your wife has changed her name in any of her other documents. In filling out the I-130, make sure to list both the married name and maiden name of your wife. Either name could be under the "Other Names Used" section. Then get a new passport listing her married name anytime before her visa interview.
  9. 10-year GC. Because IR2 are considered separate cases, independent of their biological parent's US immigration. Unlike K2, which are tied to the K1's case.

  12. If your partner threatens you about the I-751 again, laugh at their face (from a safe distance). As mentioned above, you may file solo I-751 with divorce waiver and get approved. Many VJ members have done the same, some even without professional help. But if you would be more at ease filing with help from a lawyer, hire a competent and trustworthy one, who has a lot of experience with I-751 divorce waiver.
  13. If your wife intends to re-acquire her Filipino citizenship after becoming a USC, better to put off your stepdaughter's passport renewal until then. Your wife will need a new PH passport anyway (if she wants one), as her current passport will be legally voided upon taking the US oath.

  17. No action required at I-130 stage re: your arrest record. You may upload more than 5 documents, just not at the same time because the system is glitchy/laggy. Also make sure that each document is within the file size limit (6MB, IIRC).
