If you file for AOS, before you get your green card or AP travel permit, you cannot leave the US without abandoning the AOS process. You could get lucky and have your AP or GC within a few months. If you're not lucky, it could take a year or more. If you're fine with that uncertainty, get married and file for AOS as soon as possible. You must be truthful when filling out the forms and answering the questions at the medical. Lying could result in a lifetime ban.

  8. Are they Ukrainian? If not, your friend is severely misguided if he thinks the petition will be approved in 6 months. Tell him to expect the K1/K2 visas in late 2024, if he's lucky.
  9. Which petition? I-129F for K1? Or is he going to get married on this visit, then file the I-130 for his wife-to-be's CR1/IR1? If I-129F, believing that it will be approved in around 6 months is delusional. Current estimate is around 15 months, just for the petition stage, excluding wait time for consulate interview. If I-130, 6 months for petition approval is possible, though very optimistic. 12 months would be more realistic. But who knows, your friend could get lucky.

  12. Yes, from the "Resident Since" date on the GC. She may apply under the 3-year rule if she has been an LPR for 3 years AND married to a USC for those 3 years.

Note that some J1 visas may have a 2-year home country residency requirement upon completion of the J1 program. If your J1 visa has that, it may delay your return to the US, even if you get H1B through the lottery. Have you talked to the company's immigration lawyer yet about the H1B process?

If it is a 2-year GC, file an I-90 due to USCIS data error. Filing I-90 due to that reason will be free.
  20. Likely because you don't reside in the UK. Did you send the DCF request to the consulate in Dublin first, and they denied it saying they don't accept direct filing?
