  2. It does NOT depend on whose name appears first on the IRS transcript. It doesn't matter even if the petitioner makes $0 income. It doesn't matter even if the sponsor's household member is the "head of house". It is the petitioning sponsor who must sign the I-864, even if their name appears last on the IRS transcript.
  3. They are asking about "Other Names Used" for the USC. There is no such field for the USC on the current edition I-751 form, not on page 3 or anywhere else. @KBCN -- No need to worry about USC's other names on the I-751. But it would not hurt to add your wife's other names on part 11, if you want to note it for completeness/consistency with your other documentary evidence.

  11. I hope you have a faster processing time than we did 🤞🍀 Fortunately for us, we didn't need the transcripts for anything other than our personal records. By the way, your IRS Tax Return transcript will not be updated even after the amendment has been processed. Only your Tax Account transcript and Record of Account transcript will show the amendment. From https://www.irs.gov/individuals/transcript-types-and-ways-to-order-them -- "Tax Return Transcript - shows most line items from your original Form 1040-series tax return as filed, along with any forms and schedules. It doesn't show changes made after you filed your original return."
  12. Status of IRS account transcripts as of today, more than a month after getting our additional refund checks -- 2020 amendment: Still not reflected. My spouse originally filed as "MFS", so IRS shows my account transcript as "N/A". 2019 amendment: Already reflected in account transcript and record of account transcript. Both now show our "MFJ" filing status and my (truncated) name & SSN.

  15. I think you misunderstand the OP's situation. They are a US citizen, not a foreigner with a pending US visa application. As for their Cuban fiance, it is definitely allowed to have an I-129F and an I-134A in process for them at the same time.

  17. If the 12-year-old is listed as a K2 visa applicant, then yes, they have to attend the interview. Did you submit a DS-160 form and pay the MRV fee for the child? Did you not get an email from the consulate with instructions when you scheduled the interview?

  20. Did you spend at least 5 years (total) in the US? If so, were 2 of those years after you turned 14 years old? Do you have school/employment/medical records from those years you were in the US? I'm asking because your son might already be a US citizen. If there is a chance your son is already a USC, the consulate will deny your son an IR2 visa, as USCs are not eligible for any kind of US visa.
  21. The consulate has final authority on visa-related matters, so if they want the IRS transcripts, then it's required, regardless of the I-864 instructions. But since you filed taxes very late and have no way to get the IRS transcripts soon, all you can do is have your wife attend her visa interview, explain the situation with your tax filing, and hope for the best.
