  1. NO -- it doesn't apply in your case. You are not an F-1 student. You are an AOS applicant. As such, EAD is required for any sort of work, including internship. In fact, even F-1 students are strongly recommended to apply for EAD. Scroll down the page you linked to see this note -- "Given the difficulty and ambiguity of the DOL six-factor test, the safest rule for international students should be that, if a student is providing a beneficial service to an employer, whether paid or unpaid, the student should obtain proper authorization to work."

  4. A case is not supposed to have both I-864W and I-864. The I-864W is a "Request for Exemption for Intending Immigrant's Affidavit of Support", so why submit I-864 as well for your son? If you are a US citizen and your biological son is below 18 years old, submit only the I-864W. Delete the I-864 forms that you uploaded for your son's case.

Your spouse is planning to adopt your child anyway, right? You can do a name change for the child as part of the stepparent adoption process. Minor child name change petition (without adoption) through state court is also an option. Either option is a much more straightforward process in the US than in the Philippines. To change the child's surname in the Philippines would require a PSA birth certificate correction or a name change through the court system. PSA BC correction would not be an option for changing to your spouse's surname as your spouse is not the biological parent. Surname change through PH court order would only be an option after the child turns 18 years old.

But if you get an RFE for I-693 despite having a completed DS-3025, it usually means USCIS intends to waive your AOS interview. Path of least resistance is to go to a civil surgeon, get a completed I-693, and respond to the RFE.

If you do decide to update your documents, I suggest waiting until you have your 2022 tax return transcript if you can get it before the visa interview. You may upload documents to CEAC any day before the interview, no need to do it now.
  8. Because married people have actually pursued K1 visa instead of CR1 visa in the hope that they could get a visa faster and enter the US sooner. This is a well-known fraud to consul officers, hence the many reports here on VJ of denied K1 due to appearing "too married".
  9. K1 is a non-immigrant visa. But prior to visa interview, K1 case tracking on CEAC is under immigrant visa category. Typically, it will switch to non-immigrant on CEAC some time after the interview.

  11. For K1 interview, I-134 is the required form, not I-864A. No bonus points for submitting I-864A. Save the I-864/I-864A for the AOS process after US entry and marriage.

My medical expiry date was only around a month after my interview. As to when the passport with visa will be delivered, there's no guaranteed timeframe. But since the consulate asked about the applicant's willingness to travel immediately, presumably they're trying to issue the visa in time to enable that travel.
