  6. Only the consulate can change the visa issued to an applicant. CBP cannot tamper with the visa, apart from putting the entry stamp on it. It doesn't matter whether CBP writes CR1 or IR1 on the stamp. There is no such thing as CBP recommendation. It is USCIS that determines whether an LPR should get a 2-year or a 10-year green card, based on the marriage date on the marriage certificate and the date of 1st US entry. If USCIS makes a mistake, file an I-90 for free, to replace the green card.

  13. For IR5, you must bring the original or certified copy of your daughter's (petitioner's) birth certificate to the interview, even if you submitted a copy already with the petition. Maybe not her marriage certificate, but it's possible that the consulate may ask for it as well.
  14. No MRV fee for IR5. The IV fee was already paid at NVC stage. Pay the immigrant fee to USCIS online after the visa has been delivered.
  15. Check the next steps here -- https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/step-2-begin-nvc-processing.html

  17. Courtesy letter request is safe to ignore for K1 visa holders with completed DS-3025 from their overseas visa medical. The K1 medical will not expire, as long as the I-485 was filed within 1 year of the medical date.
  18. Check the threads below for reports from others (including me) who married in the US while on tourist status, visited again afterwards, then successfully pursued CR1/IR1 visa --

  20. Good luck with the SLEC x-ray machine lottery. It would have been less risky for your gf to apply for her visa where she doesn't have to deal with SLEC.
  21. In the Philippines, father's consent only matters if they were ever married. PH DFA (for passports) and the US embassy in Manila (for US visas) are very familiar with this. The child's birth certificate would indicate that the parents were not married. Check the section: "In case applicant is an illegitimate child in custody of the Mother".
  22. Wherever you read that from is wrong. There is no such requirement if the mother was never married to the father, even if the father's name is on the birth certificate. The unmarried mom has sole parental authority over her children. It is explicitly noted in the Family Code of the Philippines. No issue getting passports for her children without the father's involvement. Official list of requirements for minor child passport application here -- https://dfa-oca.ph/passport/passport-requirements/requirements-for-minors/core-requirements-for-minor-new-applications/
