  4. Unfortunately, that tax person was not very competent, as HOH is not for a married filer living together with their spouse, whether the spouse had SSN or not. Your spouse should have filed MFS if you were married and lived together in 2020. Anyway, this is more of an IRS issue, not so much an immigration issue. Immigration-wise, the only risk is if the USCIS officer notices the HOH filing and questions you about it. Not likely to impact your ROC if you have other strong evidence of shared residence.
  5. That list is outdated (seems to be from 2015). Hep B vaccine is definitely required for IR1 visa applicant below 60 years old, regardless of country of origin.   6. In that case, your plan is fine. Just bring the updated list of addresses to the interview and have the consulate staff update your DS-260. No need to upload the list to CEAC. This is a minor mistake. No need to worry. Also, if you ever lived in another country for more than 6 months, I recommend that you get a police certificate from that country if it's not too troublesome to do so. The requirement is actually at least 1 year of residence after the age of 16, but the interviewing officer may ask for a PC anyway. In my case, the officer did ask, but I said I never stayed more than 6 months.
  7. Did you live together at all in 2020? If so, your spouse was not eligible for HOH filing status. For a married filer, HOH requires that the spouse be living separately. Your immigration status at that time is irrelevant. HOH is fine for your spouse if they had a dependent (not you), and you were not married in 2020 or you did not live in the US at any time during that year. If you did live together as a married couple in 2020, I recommend amending your 2020 filing to MFJ (or MFS if financially beneficial). If the USCIS IO notices the HOH filing, they could question why your spouse implied that you were living separately.

  9. Expedites are typically considered on the basis of the US citizen's circumstances, not the foreign beneficiary's. So your husband's US job offer likely doesn't count. But it won't hurt his case to request an expedite anyway. Just set your expectations low that it will be approved. As the case is already DQ, you may need to contact the consulate directly for your expedite request.

  12. OP's VJ profile seems to be mislabeled as IR2, but from their post, the case is F2A, not "immediate relative" category. F2A are allowed to have derivatives, including children (ie. grandchild of LPR petitioner).
  13. The sponsor's IRS tax transcript OR complete tax return package for the most recent tax year is required. For interviews before April 18, 2023, the most recent tax year would be 2021, regardless of when the case was documentarily qualified at NVC. Also, the NBI clearance should be recently issued, preferably within 1 year of the interview date. Make sure the latest IRS transcript and updated NBI clearance (if needed) are uploaded to CEAC prior to the interview. If not, your parent may be asked to leave the embassy and return only after the documents have been scanned and uploaded.

  15. Yes, it's ok to use your current (unexpired) passport, then renew it after submitting the DS-260. Just bring both old and new passports to the interview.
  16. Neither. "Temporary" addresses are places you stayed in during vacations or short business trips. If you lived somewhere for reasons other than those, you most likely need to list them in the DS-260.
  17. Make sure the applicant does not bring a phone or other electronics to the embassy. Or they should have a companion or a vehicle to keep their stuff. Otherwise, they will have to pay a "fee" to the enterprising folks waiting near the entrance to hold their electronics for them.
  18. Depends on your wife's preference. There's no USCIS requirement to change to married name. If she chooses to use her married name as her current legal name on the I-751, that name will be listed on her 10-year GC, if all goes well. Whichever name she decides to use as her legal name, she should list her other name(s) in the "Other Names Used" section of the I-751.

Note that when she does get hired, she will be required to present documents evidencing such. In her case, that would be her physical GC, or her valid state ID/driver's license + unrestricted SSN card.
  20. Please clarify the facts of the case with your friend. If he was petitioned by his USC brother and entered the US on F4 sibling visa, he should have gotten a 10-year GC. No change of status required after US entry, unless you mean naturalization -- ie. change from Permanent Resident to Citizen.
  21. Is the photo on paper or in a JPG file? If JPG, just have him email it to you. Or he can scan the paper photo and email the scan to you. Then you print it at Walgreens.
