Not ROC. My adjustment of status. I wasn’t finding the right forum. I’m not even sure what advice I want or need right now because I’m emotionally exhausted!

Hi guys. So I’ve had my interview cancelled due to COVID-19 and that’s quite ok. My problem is my husband. I honestly can’t stand the man any longer. Everyday he comes with an argument and It’s gotten so bad that I end up cursing my kids due to the frustration. I pray about it a lot and sometimes I ignore him but there are times when I just can’t. We have a 2 yr old daughter together and I have Another daughter from a previous relationship. He gets mad for everything. I would record our arguments but that’s the only evidence I have. I’m at my wits ends especially now that I have to be locked up in the house with him everyday.

I could’ve appealed by submitting the i864. I know two people who did and their case was reopened but it took a long while to happen and I was not prepared to wait so long.

If the Fed says “open up the ASC offices” could individual states say “Nope” or do they have to? Maybe we stay safe in Utah for several more weeks and see if Utah opens before heading back to CA which has more cases anyway.
Let’s not run away with ourselves. The president is looking to extend that by 30 days. So chances are offices won’t be reopening until May

I'm looking for some help. I came to the US on the 11th July 2019 and married on the 19th July 2019, we filed AOS Aug 21st 2019. I had a biometric appointment in September and since had no updates until this week. We got denied based on not including the I-864.
I'm basically asking what should we do now? I know we can't appeal and know it was our mistake but we know of a couple of cases who have had a RFE for missing evidence, we didn't even get that, just a straight up denial.
Any help during this stressful and worrying time would be very much appreciated
Same thing happened to me. Mine was denied July 2019 for failure to submit i864. I did not appeal. I just refilled the whole application In August and now I have my interview scheduled for next month (but that would most likely get rescheduled)

Unfortunately you cannot petition for them to adjust status. They will have to leave the US. I’m so sorry that you are in this position. May God be with you!

But isn’t their i485 based upon me the primary beneficiary since my husband is their step dad? I thought they would give me first then my girls.

I have an issue. Me and my 10 year old twins applied for i485 in July while our i130 applications were pending based on my marriage to a usc. Mine was rejected for using l forms but the twins were accepted. Eventually I refilled in August and so out pd is one month a part. Coincidentally my i130 was approved August and the twins were approved in September. They got their combo cards in December 2019 and I got mine two weeks ago. So here is the dilemma, the girls had their green card interview in December. My husband and I went to the interview with then. We both answered questions. Their case was held for review but last week it was approved. Last month my interview was scheduled for next month. I don’t think this is going to happen in light of the Coronavirus being in town. My question is, how can they approve the dependent before me? Would I get automatic approval?

However, recently my lawyer added the birth certificate of my child in the CEAC and now my child was listed as one of the accompany application. NVC asked us to pay the fee and the submit all required documents - we haven't obtained a passport for our child yet. I contacted NVC and they explained now that the child was added, my case was no longer complete and it will only be complete after I submit my child's documents etc and NVC reviews them. In that case, it means it would take another few months for my case to be complete and be put into the waiting queue for an interview again. Is there anything I can do to undo this action? My understanding is adding the child with the Consulate would be much faster than going through the NVC process again. Highly appreciate any advice and I felt desperate now - we have been waiting for 4 years and could not afford another few more months delay, especially the child was just born 😢
Do what you have to do now at the nvc level. Chances are the consulate would not add the child and you’ll therefore be granted the visa and would have to leave the child behind. You’ve waited long enough and nothing is wrong with waiting a little bit more. You make it sound like the child is holding you back. Shouldn’t have gotten pregnant if you were so anxious to migrate. These things happen.

He has not given his notice yet because we’re concerned that the US may close it’s borders if this pandemic continues. If he gives his notice and after 30days the borders close, he will be without a job and a Dubai work Visa and possibly have to fly back to the Philippines. We’re not sure what to do at this point, if He should take the chance and resign and hopefully be let in the country or wait till this pandemic dies down (but God knows how long this will last!)
If the US borders close, do you think they will allow K1 visa holders?
I would wait it out to see what plays out. If the borders close then us immigration may extend the life of visas because a lot of people are already shut out from entering. So the best option for me would be to give the employer the necessary notice when the time comes. As of now, you can’t get marry before the 90 days because city clerk offices are closed and there is no way to get your marriage license.

It never said that they expedited it... they just say that they are willing to expedite it providing that you fulfill the necessary requirements

I went to them with my original. I used Globe Language Services. It’s a company in Manhattan opposite the Federal Plaza. They photocopied it and gave me back my original so I’m assuming that you can take copies to them as well.

I translated my education documents myself (I am a translator), hope that works.
I've heard WES is a good company, but I live in California, it will take time to ship it to NY and back.
I did not need mine evaluated for the i485 since I applied last August but I needed it evaluated for a federal job.

Each officer would tell you their own thing and do their own thing. Some folks got RFE for failing to submit i864 while others got flat denial. But yes, you cannot send forms in at random without having a case number to attach them to. They will be lost! If ever you have to send additional documents or paper work USCIS always tells you to attach a copy of your receipt for the case you have pending.

If the petition was sent to the wrong office, USCIS would reroute it to the correct office. You don’t need to refile anything.
