On September 22 it was “new card being produced”. On September 29 the combocard arrived in the mail.

    Congrats!🎊
I’m anticipating the arrival of my combo card this week lol. Yesterday my l-765 Case changed from ‘new card being produced’ to ‘case approved’ and l-131 case also changed from ‘case received’ to ‘approved’. So, just thinking that I will be getting the combo card.

    Here we go again...

After having to refile because the Lockbox wrongly rejected our applications we now have yet another issue to resolve due to yet more USCIS incompetence.

As background...my wife and 11 year old step daughter are adjusting status from K1 and K2.

Yesterday we received an i797 in the mail for a biometrics appointment just for the i765 for our 11 year old step daughter ONLY.

    Nothing for her mother.

Numerous hours of online chats and phone calls with tier 1 and tier 2 agents and the best they can offer is that they sent an email to the ASC handling the case and said the ASC would reply to us via email in 10 to 15 days.

Even after I told them the biometrics appointment was  for 10/7/2020(8days), they said that was all they could do and that I would just have to wait for them to respond.

I would say I'm shocked at the level of incompetence of these people but I am really not.

So at this point we must take an 11 year old child for biometrics for her i765, while her mother has not been scheduled for anything.

The level of stupidity from these people knows no limits.

Ok so I’m suggesting that the mom should go with the child and speak to the officer about it. They will treat her as a walk in and also take her fingerprints. I said that because it happens to me just 1 week ago. My biometrics appointment letter came and they did not schedule for my son. I took him with me and explained to the officer in charge. He was so professional with how he responded to me and helped us until we were done. So just try and see what happens. Wishing you best of luck!

  3. Hello everyone,

I have been so annoyed and tired of this long and ridiculous process. But today I received an update and I was wondering if I will have to wait for another long period before I can start sending out job applications.

Can anyone tell me how long after their case status changes to new card is being produced, you have received the card in the mail?  I know I have seen someone mentioned it but I just can’t find that post.

    Thank you so much!

    Hi all!

Just thought I'd share my timeline here too.

    We filed our i-130 + i-485, i-765 & i-131 concurrently on 5/31/20. They were received by USCIS 6/3/20.

We got text notifications for all of our filings on 6/15/20, and just received the NOAs in the mail today. I haven't received an NOA for i-131 yet, so hoping that comes soon..

    Good luck everyone!

Congrats. May I ask which mail carrier did you use? Thanks.

Hold on, let make it clear:

    1. For K1:

    - I-485: K1 as Principal Applicant and K2 as Dependent.

    - I-864: K1 as Principal Applicant and K2 as Family Member

    - I-944: K1 as Principal Applicant and K2 as Household Member

    2. For K2:

    - I-485: K2 as Derivative Applicant and K1 as Principal Applicant

    - I-864: K2 as Principal Applicant and K1 as Family Member

    - I-944: K2 as Principal Applicant and K1 as Household Member

Base on my experience with 2 rejections and taximan683's experience, this could be the correct thing to do currently.

Yes! Yes! Thank you so much. Hoping it will be accepted this time. Time is running out on us.

    From instructions for form i-485:

    2. Derivative Applicant (files based on a principal applicant) A principal applicant’s spouse and children, who are not beneficiaries of their own immigrant petition, may be eligible to apply for adjustment under the same immigrant category as the principal applicant. These family members are called “derivative applicants.”

When you submitted the i-129 it was for the K-1 and the K-2 was just listed as a derivative on the K-1s application.

By looking at the instructions again  I also was reminded of the correct spelling of "principal" - I've been spelling it wrong today lol

Thank you so much! It was rejected because I selected principal on l-485 and not derivative then I sent copies of l-864. You have answered my concerns about completing these forms. I will be mailing off the package tomorrow.
Thank you. Best of luck to you.

Bluee, I got my NOA1 (receipts) yesterday. I finally got both K1 and K2 accepted. So, they accepted my K2 I-864 with the K2 as the principle applicant and the K1 as family member. From my reading of the instructions over and over, I felt sure that putting the K2 as principle was wrong and I expected to get a rejection again. I'm hesitant to say that it was the correct thing to do, maybe they finally had mercy on me. I hope you get accepted on your next try. Let me know what happens. Good luck!

    Hello.
My son’s applications were rejected for this same reason. Thank you for sharing your case as I wasn’t sure how to make the correction. Now I have done a separate l-864 for k2 with him being the principal and added myself k1 as family member.Question ....on l-485 for k2 should the k2 be the derivative for category type or principal? That’s confusing me now.

    Thanks

  8. Hello everyone.

I filed concurrently l-485 & l-130 applications with my 11 year old son. My husband is the petitioner and step dad to my son. My forms were accepted but my son’s was rejected as it was incorrectly filed on l-485 part 2 under filing category/ type.
Does anyone know which Filing category/type option to select

for my son? Also in part 2 question 2 would he be in other relatives option or immediate relative?

    Thank you for responding.

Anyone whose documents received in December and still waiting?

Can we extend J1 Visa beyond 5 years while waiting for DOS waiver approval (17 weeks passed)?

I lost hopes and in situation like this it's hard to travel back to home country. I'm panicking because my J1 is ending in June.

I am sorry that I am posting stupid questions.

I really feel your pain in waiting plus you will be out of status soon. To be honest if I were you despite rules/ laws if I can’t afford a lawyer to take over my case to move forward quickly then I would go straight ahead and apply for the H1B1.
But I hope someone with better knowledge of the process will quickly answer these questions.

This is my current timeline! As far as I can tell, it seems like DOS is not following the order of receipt since I have seen a few people who submitted the whole thing after I did and they got already a favorable recommendation.

We are actually in the same timeline. I’m not sure if your process was pushed back because you changed your address. I think you will get yours soon though.

Thank you for responding. So it is for K3 Visa.
From the examples here, I started thinking that family reasons are taking a bit longer than the H1B ones. Your 11 weeks situation also falls into this. Wishing all of us luck!

Thank you. I will be changing my current J1 status to Permanent resident-Green Card. I am not sure if that’s the right way to explain it. But I have been waiting for way too long now, causing me to be checking the website numerous times during the day and even nights. Lol
