So asking for a friend. came here on a K1 visa. Got married within 90 days. AOS was filed but no sufficient funds available so the case was sent back. Before they were able to file again, the couple decided to get a divorce. How long does the non USC have to return home before he gets into trouble. Divorce is not yet finalized so he is waiting on all the arrangements (getting all the paperwork, sending stuff back etc etc). he wants to avoid overstaying or breaking the law
