my petition is I-829 . It’s ROC in employment based petition. The law is clear that Uscis is supposed to adjudicate ROC within 180 days of filing for 751 and 90 days for 829
so why bother waiting for 3+ years of waiting when you can sue Uscis in court for 400$ of court fee and a peace of mind
i got mine approved this week but i filed a mandamus in court after waiting for 3 months. so yes they can adjudicate but they choose to do in random whack order
i can think of filing a complaint at the state law board to have your attorney be revoked his law licence.
This is such a horrible and horrible advise and i cannot think of any professional attorney telling you these scenarios. you will absolutely get asked about marriage at 751 and at n-400. i

Unless you are in the border states , state police will not ask for immigration status in most states. dont freak out that much. just file paper work on time
you can buy the 2 way ticket if its cheaper. just forget about the return ticket once you land in US. not an issue. use skiplagged ( search on google) for cheaper tickets.
uscis wants all criminal records whether some court expunged or not or the case vanished accidentally. you cannot decide that because your court expunged the records that means USCIS does not want them.
sealed and expunged is irrelevant when it comes to USCIS. it matters to court or civil system but not to USCIS
i think the idiots at USCIS are working backwards with sending out the 48 month extensions. like the new applicants are getting 48 months extensions before older applications. i doubt they have got to 2021 yet..
iam puzzled by them sending i-94 along with a letter. this is really new.. never heard about this.. may be you do have the 48 month extension letter in mail. who knows

why would ICE get involved unless he gets into trouble by himself . he entered legally and overstayed. it seems a straight up case unless he has trouble with law
and what would you do say 2 years from now they find out and put your on fraud case and deport you back to italy . JUST DONT DO IT. if your marriage was in good faith , you should have no issues getting 751 approved.
why bother with two litigations when you can file wom for both i-751 and n-400 together. waste of time and resources doing it twice when you can do it one shot
