Does anyone know where I can find information regarding K1 visa holders entering United States at this time? The embassy says to check with DHS. There is no phone number for DHS and no clarity.

Does anyone know where I can find information regarding K1 visa holders being allowed into the US at this time? The embassy says they don’t know....lol 😒

Visa approved 💪🏻 Fiancé comes in 2 weeks!! Hoping everyone here hears back from the embassies in the next month. I do know that K-1 visas are a priority for processing and more embassies are beginning to accept k1 cases every week. Stay positive don’t lose hope!!

Interview scheduled 2 weeks from now!! When we got the notification from NVC a week ago that our file was in transit to the embassy, we called the embassy to see what the next steps were. They asked us to email them documents listed on P3 letter (which we already had a copy of because of this site)!! The next day we emailed everything and they setup our interview date. During these last few months my fiancé got a copy of his police and court records, so that was a HUGE timesaver! Wish us luck!!

Taiwan is processing K1 now.
Omg really??? That’s great news!! Hopefully the other embassies that are open will start to process K1s. As far as I can tell, most are only processing student visas only 😒

It’s ridiculous that the same embassy gave us different answers for the same visa!
This sounds very vague and is probably an email that they are replying to everyone with

I know many of you are wondering about the k1 visa if they are allowed into the country now the ban is in effect. I will let you know my fiancée is currently on a flight right now to come to the USA. She is expected to arrive in about 9 hours from now. I would greatly appreciate people’s prayers that this would go smoothly and I hope to report good news to you all.
No that is not what we are wondering. Anyone who has a valid visa can Enter the states. We are wondering about the people who are in the process, who’s visas have not yet been issued

The Sydney consulate has scheduled an emergency interview for my K1 visa today. My interview will be next week. I expect this means that the EO doesn't apply to K1 visas since they are willing to issue one to me.
That’s great news!!!! Thanks for sharing. Would you mind sharing why you need an emergency interview?

I got in touch with Paris embassy today about my visa. My interviews was supposed to be on March 18th, cancelled and pushed back to May 20th. They are telling me that is it likely that my interview will be cancel again so it makes me wonder if K1s are really part of the exemptions of the EO. France will be out of stay at home mesures from May 11th so I wonder why my interview will be cancelled again apart from the fact that they consider K1 are included in the immigration ban and so are following measures and not issuing my visa.
Don’t worry. Most embassies are not processing ANYTHING right now- only providing emergency services to US citizens. I asked the embassy in Croatia and confirmed that when they resume services K1s will be processed

United States law does not see you as a spouse.
Technically no but the K1 requirements to get the visa are the same as obtaining the spouse visa - minus the marriage certificate. For all intents and purposes they will be treated the same.

As of now, I am not worried about this. There is no rationale to ban K-1s as their AOS takes about 6 months. Therefore, they are no immediate threat to American jobs. Obviously, the government may not care about that, but won't know until if or when an amendment is made to this EO.
Exactly!! That’s not the intent of this bill...

I called my fiancé’s embassy in Croatia as well. They confirmed that K1 visa will not be affected. I don’t anticipate anything changing in this regard. You have to look at the intent of this bill - it’s not to separate spouses

I disagree. when they immigrate and get married, they will be a spouse of US citizen- so they would be excluded from the ban anyway

That's what I'm thinking, given that it's non immigrant it is unclear. I don't know whether to understand the EO as this is what effects people entering as an IMMIGRANT, or if it means this applies to everyone and this will be the only entry to US allowed right now, if that makes any sense what so ever?
I hope K1 is included as an exception. If "spouses" are exluded from ban, i think it would be logical to exclude fiances from the ban as well... fingers crossed!!

on my NOA2 letter, it says the expiration is July 27, but my fiance is planning on moving to the states in spetember. Will i have to request an extension? Does the expiration date on the NOA2 signify the person has to enter USA by that date with K1 visa OR that the k1 process (embass interview) need to be completed by the expiration date? I was under the impression that K1 fiances had months to enter USA from the date the visa is issued not NOA2...

@Greenbaum I have a question regarding form I-134, the Affidavit of support for the K1 visa.
How do I fill it if the Petitioner is currently unemployed, but his last tax return as employed meets the poverty guidelines?
Thank you in advance!
when does this need to be submitted?

January 2021 - AOS Fillers
in Adjustment of Status Case Filing and Progress Reports

My husband and I filed AOS on Jan 20th (he came on a k1 in nov). We had a family emergency a few weeks ago and had been trying to request an expedited travel permit. We had to schedule an emergency biometrics and info pass appt (I had to get a senators office involved). Finally Almost 3 wks later we recieved a notification that his EAD and AP have been approved and the AOS is ready for interview. Good luck to everyone as these wait times are frustrating. Let’s hope that as our country gets back to normal and opens back up, USCIS processing catches up on cases.
