  1. This is a clear example of why we don't rush to send any application, especially if there is no deadline to submit. This is also an example of why some attorneys might be more interested in the $$ than helping the applicant. Furthermore, this is also an example of why an "immigration" lawyer should never give tax advice. There is no point in waiting to file 2023 taxes to download the 2019-2022 tax return transcripts. They are readily available now. I'm sorry, but it sounds to me like this lawyer does not know what they are talking about. Even though the last five years of taxes are not a requirement for initial submission, it is, indeed, in one's best interest to include them with the initial application. The more relevant information an officer has when reading the application, the higher the chances of a speedy approval. Taxes not only prove that you were married, which you weren't. Taxes prove good moral character. The employment part is a non- issue. Simply prepare an errata sheet, print it, sign it, and bring it to the interview. Before you are sworn in, tell the officer that you have some corrections to make. I did this with more "compromising" information such as weapons training. I am now a citizen.

  4. Right, but when you say that your attorney has been with immigration longer than us, it seems that you're more on the attorney team lol. Plot twist: we have seen attorneys make horrible mistakes here. Seems that their teams were not really good lol

  6. With a CR-1 visa, she will be a resident as soon as she lands into the US. She can leave a month later with no issues. Just keep her visits abroad shorter than six months, since she a resident can lose residency if their visits are longer than six months. However, if she does need to stay longer than that, she should apply for a re-entry permit, which would allow her to stay abroad for 2 years with no risk of losing her status.

  8. I think any answers you might get will be speculative. Both my 485 and 751 were approved without an interview. I did have an interview for N400 and even though my 751 had already been approved, my husband came with me and they still asked him one or two questions

  10. Congrats. I 100% understand how you feel. I applied for my passport October 1st through USPS. Passport came in the mail Nov. 10th. Certificate was in the mailbox exactly one week later. I was going to put them away, but I realized I still have to go to the SSA, the bank, and the DMV to update my status.

  13. I don't think you will have issues if you divorce and need to remove your conditions on your green card if you divorce. You seem to have solid proof, such as joint bank accounts, leases, health insurance, etc. I also do not think the postnuptial agreement is something you need to disclose. If they ask, of course you will be honest about it and explain what it is and why you did it, but if they don't, no need to say anything about it. And I doubt they will ask you about it, because how will they know? Ultimately, a postnuptial agreement does not mean the marriage isn't bonafide imho.

  15. It seems then that this is the best option. It was my understanding that name changes in general could delay the process because they do different background checks. But again, I do not know how things work on the Philippines side of it. If I recall correctly, I think I requested my name change on my 485 (I adjusted my status from F1 student visa) and I went to SSA and banks once I received the green card. My 485 took six months. Now when I applied for my citizenship it took longer than most folks from my FO and several attorneys told me it was because of my name change. Who knows.
  16. I have no idea how name change works in the Phillipines, but what I do know is that, for the immigration part of things, it delays the process significantly because they have to do background checks on both names.
