If you apply under the three year rule, you have to be living in marital union. You're going to have to wait five years in order to avoid this issue.

It happens. Sometimes those RFEs are generic letters and they include stuff you've already sent. Just send it again. Not quite. How about a joint bank account? More utility bills? Family gatherings, hanging out with friends, etc etc.

It's the same as your 751, you can file 90 days prior to your 3 year residency anniversary. However, because the receiving computers seem to be on PST, I would advise you not to file exactly on the 90 day mark because it might be rejected. We have seen some cases like that here. So just wait two or three days after.
