  2. I think that overstays for minors are forgiven. But even if it was not, overstays are forgiven for spouses of USC. Of course, if asked, disclose it

  5. Just to chime in (I haven’t read all the comments yet) once you submit your paperwork your husband will not be able to work, even remotely.
  6. I think (but I’m not so sure) that you’d also need to bring your EAD card, should you have one. IRS tax return transcripts is the way to go. Don’t take the whole return. To me, that’s an overkill. It’s either or, and I’d do 1 statement quarterly since the time you got married. Yes.
  7. As others have stated, you have a misunderstanding of how the process would work in your case. Intent was established at the port of entry. They didn’t think the had the intention to stay and they let them in. People adjust status in the US all the time and for different reasons. I was one of them. I entered on an F1 student visa, had no intentions of staying, but alas! Met my now husband, fell in love, and here we are almost seven years later. The officer will not think that you committed fraud. In fact, I don’t think they’ll even ask the question of “I see you had a k1 pending, but then you adjusted status. Why?” And if they did, you’d have all your medical information to back up why you needed your husband here

  9. Marrying a year after arrival is not so much of a red flag. Marrying someone outside of your ethnicity is not either. And no, your wife not working is also not a red flag. That’s why you have a joint sponsor. You still didn’t answer one of the questions and it is, did you ever say you were married to obtain a b1 visa? Have you looked at your DS160? Also, a few comments above you said all was good with your ex wife and now you’re talking about abuse. So what’s what?

  12. There is a reason why your case has been pending since 2018. Some key questions: 1) did you state you were married when you applied for your b1/b2? 2) how long after your arrival did you get married? 3) is your first spouse from your same ethnicity?
  13. So if I understood correctly, she was adopted by a USC but never brought over. If so, what was the point of the adoption?
  14. OP, we kindly asked you to post a picture of the letter. As we said, this would be a first and it would really help others in the same situation. Can you please post the letter where they explained the refund process?
  15. I would also write a letter to the director of your field office explaining why you did not go to the interview. Did you check the document tabs in your account? Are you sure the notification is not there? Although you’d still get a paper copy of it In the mail
