  1. What do you mean? It’s either black or white, you were either working or not. The waiver that they’re looking for is for material misrepresentation (saying that you were going to visit when instead you were “apparently” working), so the bar is a bar for entering the US on any visa, not just a tourist visa. That attorney was very wrong. It’s not like one gets a bar for a tourist visa but can enter on a fiancé visa. Most likely you’ll need one, so I’d tell that attorney to start working on it.
  2. And the whole purpose of it is just stupid. They say it's to prevent marriage fraud. But if they're really worried about marriage fraud, then don't take that long to dig into a case.
  3. Exactly. My husband is from West Virginia, and we moved to Columbus for job opportunities. Thank God we both have good, stable jobs, but just like you, we count every single penny before we spend.

I haven't filed my N400 yet (I will next month, fingers crossed!) but from what I have seen, if she filed online, she should log in to her account and any notices sent should be under the "documents" tab. The email is just a heads up for her telling her that there should be a document there. Hope I'm clear.
  7. This is how we organized it: Cover on top. Check Cover letter Form G-1145 Form 751 Evidence organized from newest to oldest. For example, most recent bank statement on top, followed by the older ones. We hole punched on top (because the article that @Chancy posted was released after we filed) and held everything together with a 3" inch ACCO binder and a piece of cardboard at the back, for more stability. Used sticky dividers on the side We wrote the name of the documents with labels that we created using a DYMO label maker. Sent the package in a sturdy FedEx box.

  9. I would understand premium processing for applicants that are outside of the US separated from their loved ones. Not for a 751 though. We are already inside the US and can do pretty much the same things that a USC can except for vote. Therefore, I don't think we need "premium processing". What we do need is officers able to review a case in a few hours or days. It is not rocket science to see whether a marriage is bona fide through certain documents and their trajectory.
  10. Because at least in some cases the use of the attorney is optional, meaning, you don't HAVE to have one. But you DO need to fill out these forms if you want to stay here legally.
  11. Wait, what? why are you filing I-90? is your spouse a USC? Also you said you will have oath ceremony, so it’s unclear what you want to do.
  12. Your spouse living here in the US while your visa is being processed would make no difference in the outcome nor would it make it faster. At some point, though, they might want to travel to the US to set up bank accounts, find a place to live, etc etc. In addition, it is a requirement that they either travel before you or with you when you enter the US.
  13. I see. He needs to get in touch with the office of international students in his college (if there is one) and update them about the denial. Going back to your question, no, he has no legal basis to adjust through you. He needs to leave the US, and once you become a resident, you can petition for him. But since he is here illegally, most likely he will incur in a bar, which he will have to serve outside of the US
  14. A visa is for someone that’s not a resident. She’s a resident, so the right term is “extension of her (resident) status”
  15. It’s been established that he’s in school. Did he apply for an F1 student visa to get to school?
  16. Soon you’ll learn that coming on a tourist visa with the intent to stay and adjust is fraud. That’s probably what they saw in your application I bet he wanted to say “I AM young”
