  3. I’m sorry you are in this situation, but it doesn’t come as a surprise to me. We warned you that when they said it was “pending”, they didn’t really know what they were talking about. File a new 751 with updated evidence TODAY, and include an I-129b. With your filing include a letter with a timeline that explains how/ why you got to this point.
  4. Greetings, my VJers! Today they scheduled my biometrics appointment BUT they scheduled it in our “old” State of West Virginia. We moved to Columbus about a year and a half ago, I did file for AR-11 the day after we moved, and I filed my 751 from Columbus. So I called USCIS and they said that they were going to request my application to be “transferred” from WV to Columbus. She assured me that this was not going to cause any issues blablabla but by now you know me and you know I don’t buy that. My biometrics appointment is scheduled for February 23rd. The agent said this “transfer” could take up to a week. So my questions are… A) if by Monday 13th I don’t hear anything about this “transfer”, can I go to the local ASC? And in that way, if for some reason they reject me, I still have time to go to WV on the 23rd? B) If I do an early walk in here in Columbus and the transfer is completed after, would it cause any issues? @Family @Crazy Cat any suggestions are welcome…
  5. I guess you’re not understanding that the IRS doesn’t care if you have an EAD. I even doubt they know what it is. Nor do they care if your AOS is pending. All they care is that if you meet the substantial presence test, you have to pay your taxes. Black or white.
  6. If she is an F1 student then most likely she was able to maintain her status by being physically present in the US.
  7. Yes, me, in 2020 when I was filing my 2019 taxes, I was on an F1, married, but still not a permanent resident for immigration purposes. And we used Liberty Tax, which is essentially the same, with no issues.
  8. You’re mixing pears and apples. If you meet the substantial presence test for the IRS (Google is your best friend) then you are a resident for tax purposes. It has nothing to do with your green card status. Filing on paper or electronically has no bearing on your status either. Use TT from the comfort of your home while wearing your PJs.

  10. Same exact situation for me, other than I submitted the day before you. I think that what happens is that they update first on your account, and the message and notification get to you a day later. So there is nothing new on your account other than what you just saw. Did you get the biometric notice?
  11. After cursing so many times because the computer self- populated the fields, that's what we ended up doing too!

  13. I am assuming that the message is from the spouse, because OP says she'ss got proof that he sent her text messages threatening her... But in the text message the spouse is saying that she was an accomplice to fraud.

  17. Right! My AOS was sort of fast too, and weird... Read my signature and you'll see. But the thing is, our interview for AOS would have been in Pittsburgh, PA, which has one of the highest approval rates and actually the officer that called me was very, very friendly and nice. We moved to Columbus, so I am not really sure if Columbus is fast or not. There is another person here in VJ that is going through Columbus, and his wife got the interview in four months. And another one in three weeks. But my issue is, I don't even have the biometrics, so my application is still at NBC and it will be there until someone finally decides to look at it.
  18. Wait! Looking at your timeline you applied in January and you already received interview letter!
  19. Exactly. Mine has been sitting at LIN for almost a year with the fingerprints applied to my case and that is it. I am always happy to see people being approved, but I am not happy with the inconsistency that USCIS shows accross the board. I just saw a person being approved for ROC at LIN in 22 days with much less evidence than I have.
