2023 case I-130
Rocio0010 replied to yangshang0's topic in IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports
What country are we talking about? That's important information that will give you a more accurate reply. Is there an age difference? Has the petitioner applied for a visa before? -
Address Change Timing
Rocio0010 replied to stag's topic in Removing Conditions on Residency General Discussion
This person has already filed their 751. And no, it does not always "stick". When I filed for N400, a year after my 751, USCIS sent me to my older State for biometrics. -
Address Change Timing

If they were going to send you something this week, you would have received a notification by now. So no, don't update it now. -
My 751 was approved about a month before my N400 interview. I do not remember the wording of the interview letter, but I did attend with my husband and I am glad I did because the officer did ask to see him. Officer made it clear he was unaware of the approved 751, so maybe your situation is similar. I would not worry (but I would go with my spouse)

N-400 question: child and spousal support
Rocio0010 replied to NataliaM's topic in US Citizenship General Discussion
My husband pays child support for his son, who is a minor. I listed him on the N400, ignored the child support warning. Now I am a citizen, so. -
Combo Interview, need to bring children?
Rocio0010 replied to travellers's topic in US Citizenship General Discussion
No, no need to bring them and often seen as a nuisance in the context of a formal interview. However, do bring documentation that proves that the children were born to this marriage, such as birth certificates, school records, and family pictures. -
Seems the system is: call and get an appointment. Once you have that appointment, you can attempt to do an early walk in. Which makes no sense to me but I guess no one cares what I think. Maybe the reason why I was able to do an early walk in is because indeed, I had an appointment at a later date, and I hadn't missed any previous one. But I don't remember the people at the ASC telling me anything about it. They just listened to my rant about why the f#### they'd sent me five hours away, and that's it.

I would not travel, but maybe your risk tolerance is higher than mine. Yes, you do have that extension letter that allows you to travel and work in the country with an expired green card, so long as you attend the biometrics and USCIS has no reason to deny you. A lot of undocumented immigrants work in the country, and they still work here. Just because A is true it does not mean that B is true. But I digress. Hopefully your appointment will come in before you leave. Or you can try a walk in at a different location.

So I will try to make this story short. We moved from WV to Ohio back in 2021. Surely enough, I notified USCIS of my new address. I even filed the 751 from our new address! And got all USCIS mail in my new address. But somehow when I filed for N400 they sent me to WV for my biometrics for February 23rd. WV is about five hours from me. So the first thing I did on that Friday when I received the biometrics appt is to call USCIS misinformation line and told them about the situation. The lady said “oooh don’t worry, I’ll send a request to reschedule you to your closest ASC”. She just laughed it off in a way. I have an ASC that’s 20 minutes from my house. So I decided to ignore her advice on the phone not to worry, and took matters into my own hands. I did a walk in first thing in the morning that Monday, and I’m glad I did because they never rescheduled me.

I did an early walk in for my biometric appointment for my N400, because by mistake USCIS sent me to my older State, which is about 4 hours from where I live now. So I attempted an early appointment to see if I could avoid the drive, and missing one day of work. Alas! It worked. I went to my appointment first thing Monday morning (I was at their parking lot at 7:30 am) and they let me in. I did tell my supervisor at work, though, that I did not know if I was going to come in that morning because this appointment was very important to me. As others have stated, without your biometrics your case will be denied, and then later on you might be out of status, so your job might gown down the sink as well. Not worth it!

I-751 evidence years
Rocio0010 replied to oolongtea48's topic in Removing Conditions on Residency General Discussion
I was approved without an interview for both my 485 and my 751. I followed instructions to the T, and for the 751 I submitted some "substantial" evidence that I had already submitted with the 485, particularly IRS tax return transcripts, joint leases, and joint bank statements together with some wedding pictures. As @OldUser has rightfully explained, each application is stand alone, and should be approved on its own merits. Basically because they are reviewed, approved/denied by different officers. -
Citizenship interview canceled
Rocio0010 replied to Adihan's topic in US Citizenship General Discussion
Why does your post title say "Interview Cancelled"? -
I’m sure you had a good heart on this one. But you actually hurt yourself because you allowed the petition to proceed even though you knew that you were no longer married. He got his green card through a sham marriage that you were part of. Did you also know that you’re on the hook for the I-864 until he becomes a citizen, works 40 quarters, or naturalizes? This is bigamy in the US. In a lot of States it is a crime. forget About k1. That ship has sailed. You’re too married. Firdt of all, most visit visas are denied, especially to a man of a marriage age from Syria. That in and of itself is a factor. The other factor against your case is that he’s married to a USC. So, he’s not going to get one. But even if he did, coming to the US with a visit visa with the intent of adjusting status is fraud. Don’t do it. That would definitely, definitely complicate your case even more. I think this is a Jim Hacking question.
