To @Boiler's point, if you married in September of 2021, she should have received a 10 year greencard. If she received a 2 year, it is likely in error. You should probably verify. -

Yes. But you should check to make sure that you're up to date on anything new that may have been added. I think it's HepB, in addition to the covid vaccine, that catches people out.

Because the petitions are independent, it doesn't really change the amount of time it takes. You are correct, probably 2 years or so, all told, as long as you've build strong evidence of a legitimate relationship and there are not RFE's or issues with the children's father providing permission or court ordered sole custody to mom. Kids are typically easy for the system because well, they're kids. It's adults who have histories including work, travel, etc that take longer to verify. -

You should be able to because you're a citizen. However, your hubs may be scrutinized so make sure you guys have STRONG ties to Canada for him when he's with you, indicating he's returning to Canada to finish out the process. Letter of employment, lease agreement/mortgage, current bills, etc. He may never be asked, or he may get a cranky CBP officer and that's just not a fun thing to deal with. Make sure you create an inventory of what you're loading into the trailer - hand written is fine. Good luck with the staged moving!

If you search the Montreal consulate, there are many reviews with information posted, including recent ones. Regular AP (all cases go through some level of AP) or was a 221g or a DS5535 issued? If it's regular AP, as long as everything was in order and as long as your name isn't super common, it shouldn't be too long. If your name is common, expect more time. If it's a 221g or the DS5535, check out the thread posted above because it will take some time.

As long as your spouse's L1 is valid and their I-94 doesn't have any errors, should be fine. The interview is with USCIS and they have access to FBI records, hence why you never need to get an American PRC. @Froozion congrats! Sounds like your interview was pretty much the same as our IR interviews were back when we did them. More of a verification that the documents submitted were real and true and that your answers were in alignment with what was submitted. Good luck with the logistics of your move! Are you in The Pas?

Rant here...anyone else as completely over UPS and I am these days? Ordered a power cable for a security camera because Kid1's car is being vandalized by someone that's targeting her and knows we have a Ring camera doorbell. Security cam is on the eve of the house and oversees the entire driveway and most of the front yard now. The cable for the camera was supposed to arrive Sunday. I was grumpy that it delayed on Sunday and rescheduled for today. Go to check my orders and now it's supposedly delayed until Thursday due to "severe weather". What the deuce?!?! Yes, there is a TS in the GoM. Yes, it's headed NE but it's due to hit Louisiana TOMORROW!!! Every time there's even a hint of weather, UPS claims weather delay. They are about as reliable as Centerpointless with our power! This is completely and utterly ridiculous. USPS had people out during the ridiculous storm in May and then again right after Beryl and I normally don't have tons of nice things to say about them but UPS is making USPS look like All Stars!

Did this yesterday myself while hubs changed the oil on the Jeep. I also got a little sun toasted as I weeded the side and front flower beds. LONG overdue. Much nicer looking now. Usual story with Kid2 here. That said, he's worked out a deal that if he keeps his average up until the end of the next marking period with no grades below an 80 and no more than 2 grades less than a 90, that we will preorder a computer game that he really, really wants. I'm ok with it. If it keeps him motivated, good enough. We have to take Cat 1 and Cat 2 to the vet today. Cat 3 and Dog need to go too, but I can only carry 2 cat carriers at a time, so the Boomers get to go first. The dog can go in combo with any of the cats but Cat 3 cannot go with any combo of the other 2 cats so the dog is his vet partner!

I just really love and respect Em and Kobe's relationship. Yeah, it's had some bumps, but what relationship hasn't? At the end of the day, they do really care for one another and have some pretty cute kids. I too, appreciate Kobe's relationship with his inlaws. He really does love Em's dad! Loren needs therapy. Full stop. I swear she's on the show to fund the plastic surgery she insists she needs. I'm over it and was before it even started. Agree on Angela's screaming being triggering. I just get the heebie jeebies thinking about it. New Before the 90 Days...agree...interesting...

Get everyone's titres done now. It will show immunity for the vaccines everyone has had and then you'll only have to fill in the gaps. Covid vaccines are basically being treated like flu vaccines - they want you to essentially have them yearly, so the kids will have to have a recent dose.

If you get married before you file anything, you're no longer eligible for a K1 visa, full stop. If you're of an Islamic persuasion, you can't do a Nikah and apply for a K1, either. The only option at that point is a CR1 visa. -
Yup, golden if she's there in advance. The timing will depend on whether or not you want to avoid a joint sponsor or not on the AoS. If you guys don't have an issue having a joint sponsor or have sufficient liquid assets to meet the requirement, then she can come across with you as long as you've sufficiently proven intent to establish domicile during the interview.

Yup, you can live together right up until you want to emmigrate Canada. Montreal is just a stickler for having proof that your partner has a plan to reside in the US when the time comes. This might be in the form of a lease agreement with the in-laws, your own property, etc. Remember, there's the I-130 that has to be filed and approved by USCIS, then the case gets transferred to the National Visa Center where you'll have to fill out the DS-260 and your spouse an Affidavit of Support. Because you're both potentially residing in Canada, your spouse may need a joint sponsor to prove they have the means to support you unless they can prove their job and income will continue when you guys relocate to the US. Once that is approved, you're put in line for your interview. This is why I say get legally married ASAP and file...18mo+ is not an exaggeration. 3 months and filing before this US election are a big deal because who knows what's going to happen and what immigration reform may or may not happen after November.

Canadian common law isn't accepted by USCIS. I'd honestly head to the courthouse and get married like yesterday and file tomorrow. Your timeline is unrealistic in the reality of things. The sooner you get started, the better off you'll be. As mentioned, you cannot work remotely while in the US without work authorization. The good thing is once you've processed through the Consulate, you'll enter the US with a greencard and have no issues with work authorization.

It's like a get out of jail free card...technically you're breaking the law by not leaving when your allotted time is up, but because you've made some effort, we'll allow you authorized stay until we make a decision. If USCIS and the government perceived this as being a real threat to national safety, they'd remove the option full stop. But, there's record of a tourist showing up. The AOS process is very visible. It's also highly revenue generating due to the number of forms filed. Anyone who's actually done any type of immigration proceedings knows it's a time consuming (and often painful) process. It seems rather unfair that none of that time and effort spent and none of the financial input required to file will all be waived. 100% rewarded for criminal activity and flying under the radar for however long. Most foreign criminals are expedited back to their home country but in this instance, they'll be made permanent residents of the USA - the exact opposite of that happens for any other rule breaking PR who've agreed to the T&C of permanent residency which includes complying with the laws in the United States. Most people want justice when people break the law, not for the law breaker to receive a reward.
