Problem is this couple has been married for a while. It is clear marriage is an event to permit an addition to the insurance outside of open enrollment. What the insurance dept/HR does not seem to understand is that moving to the US/becoming a new immigrant is also a life-changing event. Obviously he couldn't insure while outside of the US since the insurance coverage was not available there. Problem is the HR dept is being ignorant and hiding behind a false reason for denying adding the spouse.

Nothing can be done in regard to your prior green card as you abandoned it.

Since you entered on a K-1 then you can only adjust status based on your marriage to your I-129F petitioner. Since that marriage never happened then your adjustment of status application will be denied. It is not a question of if your I-485 will be denied, but when.
Take your lawyer's advice, leave the US, and file for a CR-1 immigrant visa.

Then whichever of your women wants to petition for you she can. When you go to the interview you will know if you have a ban or not.
If you truly love your woman you will do what you must to make things legal. Seems like you are more worried about being deported than you are about the woman.

You have had no status since you stopped attending school. Just being married to a USC does not give you any status. Either the attorney is incorrect or you misunderstood. You will only have status when the green card is successfully applied for.
What you will have to do is marry a USC and prove that the marriage is real and true for the purpose of love and not for you to obtain a green card. This is going to be extremely difficult for you to do given your history. You will have no success filing with your current wife since you have no real marriage. If you divorce her you and marry your current lady friend be certain your relationships will be questioned during the interview.
As to your current wife's threats to have you deported, she can report you and your employer. Whether anything will come of it no one here can predict. Roll the dice and take your chances. But understand you are out of status and subject to detention and deportation at any time.
