    Austin is beautiful and full of opportunity. Good to have plans but when you get there see what is available. You are right there are a lot of native Spanish speakers there although not so many as in San Antonio and other locals near the border. I envy you right now. San Marcos is beautiful if you love the outdoors.
    As a side-note I am a native Texan who has been displaced by circumstances but Texas will always be "home".

    I am not an attorney nor have I ever wanted to be one but what you did was commit fraud. You entered the US on a fiancé visa knowing you were married, you then obtained a marriage license in the US by lying and stating you were not married, you then filed for AOS based upon your marriage that was not a legal marriage. So you have no basis for your green card and you could, if all of this is disclosed or discovered, lose your green card, be deported, and receive a life-time ban. Sounds like you need good legal counsel to fix this.

    Married is married no matter where it happened, if it is considered a legal marriage in that country. Problem is she entered the US on a fiancé visa knowing she was not a fiancé and was not free to marry (because she already was), who knows what transpired at the POE as far as questions. She then obtained a marriage license in the US where I know you have to answer a question about being single, divorced, widowed, etc. and she lied on that. Then she filed for AOS using the US marriage certificate which technically is not a valid marriage certificate since she was already married. Now she wants to know how to fix it.
    Two choices here, don't say a word and hope no one finds out or consult with an immigration attorney.

    Not that I agree with what he did but there is no requirement for a bystander to render aid and in some places you can be held liable if you render aid and the outcome is less than perfect. Years ago I remember hearing about medical professionals who refused to assist at accidents because of the fear of a lawsuit.
    His best course of action would have been to continue on with his day, not stop, open the vehicle, and film.

    You need to be aware that the father, as an LPR, is required to reside in the US. He must maintain ties to the US such as a permanent address, pay taxes, etc. as well as spend more time inside the US than outside.

    If you are married when you enter the US then he/she is no longer your fiancé and cannot use a fiancé (K-1) visa to enter the US.

    Not just them, my spouse will believe something a random person on the street tells him before he believes me.
    You can petition a sibling from any country in the world if you are a USC. This may or may not change in the future. For the Philippines there is currently a 24 year wait.

    I don't perceive anyone as having been rude but perhaps blunt would be a better choice of a descriptor. We aren't trying to shatter her rainbow as it is obvious she is in love with this person and wants him here as quickly as possible. It has been made known to her that a financial hardship such as she described will not be sufficient to waive the meeting in person requirement. She has also been advised that Nigeria is a high-fraud country.
    This is not saying that her specific fiancé is a fraud or anything negative about him in particular, it is simply laying out the facts and probabilities to her. I hope he is a great man and they live long and prosper together......but.....the reality is they need to meet in person. The petition which has already been filed is a lost cause, time to move on with another plan. The chances of him getting a tourist visa to the US are pretty slim, she doesn't feel safe traveling to his home country, so they need to figure out where they can meet and spend time together. I would strongly advice she travel to his home, meet the family and neighbors, and document it very well. Not only so she isn't potentially taken for a ride but also because Lagos is a very difficult consulate.
    She needs to step back, regroup, and plan.

    You have nothing to worry about. I would suggest divorcing him and moving on to better pastures (men).

    Just to clear up some confusion. A felon can sponsor a spouse/fiancé. I know as I did it. It depends on the nature of the crime.
    In this case a sex crime is very hard to obtain a waiver for and it might be impossible.

    You can't make him leave. You CAN withdraw the I-864 provided his green card has not been approved yet. Without the I-864 he cannot obtain a green card and you are not on the hook for him financially.
