    If you didn't have AP when you left the US your AOS was rightfully denied as you were seen to have abandoned it.
    If you were able to come back to the US right now what would you do? Your daughter can't come as her AOS was denied (why?). You have no where to live. no job, no money, no health insurance for your pregnancy and child birth. No means of transportation unless you have public transportation where you intend to live. So you would leave your daughter behind to come here and be homeless and pregnant? Or would you return here and continue to be abused?

    Best thing to do is have all the paperwork ready, land in the US,marry the next day, hand carry the marriage certificate to the clerk's office and get a certified copy then (if available), stop at the post office on the way home and mail it out. EAD in hand in about 60 to 90 days.
    It is my understanding that some areas make you wait for the marriage certificate by mail which could take weeks. Then you are looking at, from your plan, arrive in the US, apply and pay for the EAD. Receive it in 60-90 days. Start work. Day 90 will be your last day working until you receive the EAD from AOS filing.

    Honestly it probably would have been denied anyway. You had already been out of the US for four years and wanted to stay out another two at least. I can easily picture at your interview being told apply for an immigrant visa when you are ready to return to the US.

    Why not wait until you are ready to move back to the US to DCF?

    Decide if you want to work on the marriage or get a divorce. If you have proof of entering the marriage in good faith you can remove conditions with a waiver.

    So why can't you work as well since you like to have money always to buy new things for yourself and your daughter?

    She did NOT get married in the 90 days so she is INELIGIBLE to file AOS based off of the K-1 visa. Such an effort would be denied.
    She CAN, however, file a concurrent I-130/I-485 package based on beind married to a USC and having a legal entry to the US.
    She will have to do more paperwork and she will lose $420 for the I-130 petition, but it is a fixable problem.

    You must be a citizen to petition for a sibling. Once you become a citizen you can file for her and the wait (currently) is 23 years for the Philippines.

    Go see an immigration/family law attorney.
    Protect yourself against her falsely claiming domestic violence. Well known in the PI community that this is a way to get a green card.

    I would write a formal letter to USCIS and the US Consulate with her I-129F/K1 visa information stating she is a fraud.
    Entering on the K1, she can only adjust status for a green card through you, her K1 petitioner. She can never adjust status through any other means including another USC spouse.
    Don't be upset. Be happy that you did not marry the lying

    Did you have a visa for Mexico? If not, perhaps that's why you were denied boarding. Only green card holders, U.S. Citizens and other visa-free nationals are allowed to enter Mexico without a visa. As a citizen of India, you must have a visa for Mexico.
