    1. Pull the affidavit of support. Do it by phone, in writing (notarized) sent return receipt, and by infopass appt if feasible.
    2. File for divorce ASAP. Even if she is not in the US you can still divorce her. She does not have to agree to the divorce for it to be granted.
    3. CYA she is already setting you up for a VAWA by crying abuse. You need to get out of the house before the s**t hits the fan or expect her to call the police/file false abuse complaints against you.

K1 visas are for fiancés to marry in the US. If you are intending to marry and then get married, then you are no longer fiancés but spouses. You would have to withdraw or cancel the K1 and start over with a spousal visa.

You will need to start over with the CR-1. Follow the guides at the top. It will take about 12-18 months at current processing times.
A big question is this....at any point during the interview did she lie and say she was not married? If she did they could slap a material misrepresentation charge on her and bar her from the US forever. You made a poor choice and I hope they just returned the petition as no longer eligible and nothing more.
Never, ever lie to immigration or think you can fool them. They know all.

I believe the way it works is when the I-864 is filed with NVC she will provide the joint taxes and if you don't provide a I-864a NVC will only consider her income. Same thing with assets, if the account is joint they won't consider it since you have not consented to have your income/assets used.

How will they prove no one in the US is qualified and looking for employment who can do what you can? Why would they spend thousands (and yes it is thousands) of dollars to allow you to apply for a work visa? They have to pay all the costs associated with the visa, if you pay anything you will lose the visa (provided you get one) and they will be fined.

you mean post-nuptial since you are already married?
It will protect you from your spouse coming after you for money, means nothing to US govt coming after you for repayment.
those couples who live apart have legitimate reasons like finish college in different states, temporary work assignment in different states .. etc

File for divorce, request at the initial hearing that he be made to leave the house, mention the threats he made. As for having his green card taken away, won't happen. He will have to file to remove conditions with a divorce waiver and if he can't produce enough evidence that he entered the marriage/lived the marriage in good faith he will be denied.
His refusal to sign the divorce papers is irrelevant you can get divorced without his permission.

    hi
you are wrong, you have to live most of the time here, keep doing that and they will take away your GC, plus the reason to file for a family member is for family reunification, so if you don't live here, there is no family reunification to begin with
the GC is to live in the US
for children under 21, the process takes around a year and a half

Can't help with much except to say, how can you be a permanent resident if you are out of the country most of the time? The whole point of green cards for family members is for family reunification. How can there be a reunification if you are not there?

If you didn't have AP when you left the US your AOS was rightfully denied as you were seen to have abandoned it.
If you were able to come back to the US right now what would you do? Your daughter can't come as her AOS was denied (why?). You have no where to live. no job, no money, no health insurance for your pregnancy and child birth. No means of transportation unless you have public transportation where you intend to live. So you would leave your daughter behind to come here and be homeless and pregnant? Or would you return here and continue to be abused?

belinda63 got a reaction from Unlockable in Shortest time from arrival to receiving EAD
Best thing to do is have all the paperwork ready, land in the US,marry the next day, hand carry the marriage certificate to the clerk's office and get a certified copy then (if available), stop at the post office on the way home and mail it out. EAD in hand in about 60 to 90 days.
It is my understanding that some areas make you wait for the marriage certificate by mail which could take weeks. Then you are looking at, from your plan, arrive in the US, apply and pay for the EAD. Receive it in 60-90 days. Start work. Day 90 will be your last day working until you receive the EAD from AOS filing.
