She has to legal in the country she interviews in. As to her overstay affecting the K-1 no, it will not have an affect.

You are not eligible to obtain a visa if you have a ban.

I don't understand what your issue is. You apply for the job, it cost you nothing. Your employer decides if they want to hire you and they do all the work and pay all the money. So what is your dilemma?

belinda63 got a reaction from C-ma'am in My wife is pregnant and she wants to bring her sisters from Pakistan here.
They can apply for a tourist visa to visit their new niece/nephew. If the child misses a few weeks of daycare while they are here that is understandable. If the sisters are watching the child in lieu of having child care that is work which is not allowed on a tourist visa.
Nothing you or your wife can do, the sisters will need to apply for a tourist visa.

belinda63 got a reaction from ToddB in Health Insurance in US
Yes it is part of the tax return. Proof must be provided of coverage or the penalty will be added to the amount owed on taxes.

How did she answer the question about having health insurance? I know for us we had to provide information about the coverage. It is 2.5% of your income or $695 whichever is less. This is for the 2016 filing year.

belinda63 got a reaction from Unidentified in Invalid K 1
She (and he) lied to immigration. She is now divorced from her USC husband. Her AOS was denied. Probably not. Since she entered on a K-1 she can only adjust through the person who sponsored her. But since she never should have been granted a K-1 she is in really deep mud.

belinda63 got a reaction from Boiler in K1 divorce before AOS adjudicated affidavit of support abuse
First of all getting a green card will do her no good if she is dead, which is where it sounds like this might be going. She still has quite a few months until she might receive her green card. My understanding is it is taking about a year after filing to get it. That is if he filed the paperwork and doesn't pull the affidavit of support.
She should either leave him and report the abuse and file for VAWA Iwhich will require more the pictures) or leave him and go home.

belinda63 got a reaction from mallafri76 in VAWA + my rights over dead spouse's belongings
You can obtain a copy of the death certificate from the local court house. Google the county he died in or the state he died in website for information on how to obtain it.
As to his estate it will go through a process called probate and an executor will be appointed. You can file a claim with the probate court for your share, if any, of his estate. Part of what will come into play is if he had a will or not.
All of this can be done from overseas.

belinda63 got a reaction from Anitafeliz in 1-130 apprvoed but still removal proceeding (merged)
You will have to file a waiver. Period, end of it. To adjust status from within the US you need the deportation case dismissed. Otherwise you have to leave and do consular processing and get an approved waiver (if a waiver is available). I don't even know if the I-130 will need to be filed again since the one already pending was filed when you weren't eligible, ie you can't file for a green card when you already have one.

It is highly unlikely that they will give you a new green card after taking your old one. She will need to file waivers anyway if you are deported and with your criminal offense. You can't stay in country while she does that.

belinda63 got a reaction from Anitafeliz in Fiance run away do not know where she is staying
Oh this poor woman. She gave up everything in her country to come be with the love of her life and he was abusive to her and treated her like a slave. When she wouldn't do what he wanted he turned off her phone and threw her out of the house. Now she had to run to a shelter to hide from him and have a roof over her head. Please give me a green card because I was abused.
Of course this is what she will claim. Good thing they never married so she can't file VAWA.

belinda63 got a reaction from EM_Vandaveer in Determination of american citizen child
I believe the letter denying the CRBA is what they are wanting. A visa cannot be issued to a US citizen thus they need to know he has no right to US citizenship which was determined when the CRBA was denied.
