    Correction everyone. There is a gift tax. Beyond that I know nothing but my name is not Jon Snow.
    Google it, it must be over a certain $ amount to trigger the tax and I am not even sure who has to pay the tax.

    Back to the topic, He would need to leave the US and wait for the son to become a citizen and petition for him. 
    Simply having a social security number does not grant the right to work. How is the father filling out the I-9 for his employer? If he is claiming he is a US citizen this is a major issue and could result in a life-time ban.

    You as the USC can return to the US at any time. You choosing to remain in a foreign country to give birth is just that, a choice.

    Several issues with this.
    1. If he obtained his green card through marriage with a USC he must wait five years before petitioning a spouse (exceptions do exist).
    2. As a green card holder his spouse/child cannot adjust status from within the US unless they are lawfully present and their priority date is current.
    3. He committed bigamy which is a crime.

    Agree, since he entered without inspection he will have to interview outside the US. If it is that big of a concern he can leave the US now and take care of business while he is waiting for his interview date.

    Technically you are not married to him as he was not legally free to marry. He needs to divorce the first woman then he can marry you.

    I can't think of a way around this since he has already been convicted unless there is some way to appeal and have the conviction vacated or reduced greatly to possession of less than the waiverable limit. 
    Post conviction relief won't help because he will still have the conviction on his record. 
    Best they start looking at the requirements for her to move to his country.

    She will need to prove the abuse and prove she entered the marriage in good faith.

    Possible issues with proving the marriage was real as she was cheating on him less than two months after marriage.

    Answer the simple question. What documents will you show when you fill out the I-9? If you don't have the proper documents they cannot legally hire you.

    He was deported and lost  his green card. No way you are getting back into the US with two felony convictions. Suggest you focus your energy and money on making a life in another country.

    Problems with timing. Three months until she give birth then she has to wait for the birth certificate then she has to apply for a passport for the baby and receive it. Even if she get the full 6 months when she enters the timing will be really tight. 
    Problems with you signing/co-signing for anything for her. You are the one on the hook. No matter how good a friend or family member they are I never trust anyone with more money than I can afford to lose. Have her pay you in advance (before signing the lease) for the 6 months rent. Even the best of friends seem to "forget" to repay their debts, especially when they are in another country. 
    Hope everything goes well for her and the baby as a normal birth can cost more than $5,000 and if complications arise we are talking a lot, lot more. Also remind her the US has the highest health care costs and one of the highest infant/mother mortality rates of developed countries.
