belinda63 got a reaction from Vabsmith in Petition to Parents, Form I 130
Medicare is a benefit that is earned by being paid into as you work. It takes a certain number of quarters of eligible work in the US to obtain Medicare benefits. It is highly unlikely either parent will qualify. After they have been LPRs for five years they can buy into Medicare. In the meantime you will need to provide health insurance through a private insurer or from the market place but they do not qualify for the subsidy.

belinda63 got a reaction from Celie in Live separately affects AoS?
My question during the interview would be....if the two of you aren't living together why do you need a green card, you could have this kind of marriage with you in your home country.

You are going to have a hard time with this. Your green card renewal has already been denied. You have zero proof of a legitimate marriage to the first wife. You then married another US citizen and are trying to obtain a green card or stay of removal through her. It very much looks like you are just looking for a green card.

So you never lived in the same house and you were only in the same country for a month? Good luck with that.
First you need to deal with the denied I-751. You can't apply for a green card because you still have one.
Honestly you have a lot of red flags in your case.

He may not be a US citizen much longer. If it is found he obtained his green card by fraud his citizenship can be removed and he can be deported.

belinda63 got a reaction from SalishSea in Denied due to Public Charge Ineligibility
In the US it takes more than a part-time job to support yourself, much less a family. Many people here work multiple jobs and still barely get by.
You are going to need some job skills to show you can be employed when you get here in a job that will support two children. Health insurance alone will be very expensive.

belinda63 got a reaction from geowrian in I-751 filed under VAWA
All I can recommend at this time is work with your attorney. Seems like a long time to be waiting on a response to the RFE. Have you checked your case status online?
Yours in not a VAWA case, it is a removal of conditions. It should process like any other removal of conditions.
You are required to update your address within 30 days of moving if you are a green card holder.

belinda63 got a reaction from Pitaya in I 485denied. Can I get work visa or something instead?
You need to either refile AOS or leave the US. You are out of status and accumulating overstay time at this point.
Arguing with USCIS won't do any good, you have 87 days from when an RFE is issued to respond. It does not matter when you received it, how long your work took to do this, etc. An RFE is a chance to correct an error, they are not required to issue an RFE they could have just flat out denied you.

belinda63 got a reaction from Pitaya in I 485denied. Can I get work visa or something instead?
The RFE was not responded to within the time limit. Your AOS was denied for this. You have two choices, refile or leave the US.
The EAD is tied to the AOS, if the AOS is denied then your EAD is denied. You cannot obtain an EAD without a pending AOS application so I'm not sure on what basis you filed for a second EAD.

Have you told your spouse you are just staying with him to get a green card? Will you tell this during the interview for your green card?
-
belinda63 got a reaction from geowrian in Temporary work permit
Filing for the EAD prior to AOS will grant an EAD good until the I-94 expires, 90 days after entry. It will take 4 months or longer to get the EAD so it will be expired before it is approved.

Maybe he is still married in the Philippines?
He must have legal status in the country he interviews in. You can always change which embassy he interviews at even after it has been sent to the embassy. It will just slow down the process. For his address put where is he is currently staying, even if it is a hostel or a friend's home.

belinda63 got a reaction from geowrian in N-400-interview gone bad
Let's try to get the whole story.
You entered without inspection and got caught. You were taken to a detention center. Were you deported? If so how did you enter the second time? What did you put on the I-485 as your method of entry?
Yes you can lose your green card and even your citizenship (if you make it that far) for a material misrepresentation or fraud.
