belinda63 got a reaction from Chancy in Marriage Certificate in US and Nigeria
When you apply for the license you both will be asked if you currently single or some other verbiage to indicate you are legally free to marry. If you are already married how are you going to answer yes without lying since you are currently married.

belinda63 got a reaction from Chancy in spouse doesn't have social security number (split topic)
A few things to consider here.
1. Your spouse is working illegally which will be forgiven as the spouse of a US citizen when he applies to adjust status. But his income cannot be used to sponsor him.
2. You said his employer gave him an I-9. What category was checked for it to be completed? If they marked him as a US citizen this could be a major issue.
3. You will need to follow the guidelines for filing the 1-130/I-485 concurrently to get him a green card based upon your marriage. Since you don't work and his income can't be used you will need a joint sponsor with sufficient income for their family and your spouse.

belinda63 reacted to gregcrs2 in B2 Visa Extension - New Date Already Expired When We Received Approval Notice
So if I understand you correctly:
original entry was valid until February 29 (so I assume the original entry was for 6 months)
they applied for extension in February
They received a notice dated 9/29 granting a 6 month extension to 8/29
The maximum period of extension can be for up to 6 months and maximum time a person can live in US on B2 visa is 1 year, as there is a limit to the number of times you can apply for an extension B2 visa. Where an extension of B-2 status is granted, it is for 6 months from the time of the prior validity. Given long I-539 extension request processing times, the extension is often approved (or denied) with no additional validity time.
So they stayed beyond the maximum allowable time in the US. Don't understand what you were expecting. Did you think the extension starts when you receive the extension approval notice?

belinda63 reacted to aaron2020 in Spousal Benefit
Your wife can receive spousal social security benefits as long as she is "lawfully present" in the US. https://www.everycrsreport.com/reports/RL32004.html. https://secure.ssa.gov/poms.nsf/lnx/0300204010
Here's the problem, SSA has a problem understanding that your wife is lawfully present even though her I-94 has expired and she's lawfully here after filing for an adjustment of status. They will likely require a copy of her green card. The onus will be on you to educate them. Whether they can understand that is the big question and to why they can't seem to give you a correct answer.
Fight if you want the money.

belinda63 got a reaction from Lemonslice in Trump Could Temporarily Block Americans Who Might Be Infected From Returning to the U.S.
Unless the embassies want to provide food and beds I don't see how this is even possible. Since Covid is already rampant inside the US I don't know what he thinks this will do to stop the spread.

belinda63 got a reaction from Duke & Marie in Can i be sponsor in my case ?
So you never lived in the same house and you were only in the same country for a month? Good luck with that.
First you need to deal with the denied I-751. You can't apply for a green card because you still have one.
Honestly you have a lot of red flags in your case.

belinda63 got a reaction from Mollie09 in Has anyone used WebWed Mobile for getting married for their CR-1/IR-1?
The question is not if it would be a legal marriage in the US the question is would it be valid for immigration purposes. Even with a valid marriage certificate if you can't prove the two of you were in the same place at the same time at some point during or after the marriage your petition will be denied.

Military families go through this frequently. Children switching schools mid-year because the parent has been moved to another base.

Since he made a second illegal entry he is barred for life from entering the US as soon as he leaves. He can apply for a waiver after 10 years of being outside the US. Have you considered relocating your family to his country?
-
belinda63 got a reaction from milimelo in What form to get after getting married
Entering the US illegally for the purpose of obtaining a green card is fraud. Since you can't enter legally, you say you have no visa to enter the US, give that thought up. Do it the legal way.

It appears you did not marry within 90 days. If that is correct he cannot apply based upon the K-1. You will need to include the I-130 along with everything else, and the fee for it of course.

belinda63 reacted to Allaboutwaiting in REJECTED AOS FROM USCIS
That part is confusing as the OP says they married in May but weren't able to record the marriage so they had to REDO it in June.
@maleecka What is the exact date of marriage on your certificate?
