  1. Hi, I cannot not figure out what tax transcript they are asking for.  This is the information they give; Please upload and submit Dan's most recent Wage and Income IRS tax transcript from 2023. A transcript can be obtained on the IRS's website:  https://www.irs.gov/individuals/get-transcript. If you were not required to file a tax return, please write, and scan an explanation for not filing. If you filed taxes with your spouse, please also submit all of your W-2s and or 1099s. For more information, please visit https://nvc.state.gov/fin.  I have gone to the website and uploaded both available transcripts for year 22 and 23, sent in all of my 1099s for both years which were accepted.  Both of my Federal Income Tax Return or Transcript has been rejected. I submitted these transcripts on Aug 21, they show they have been uploaded,  I just resent my 2023 and 2022 return and account transcripts again, they have been uploaded alng with the same transcripts i sent on the 21st. I even filled out Form 8879 for both years and uploaded it.  I hope someone can give me guidance on what I need to send in.

Thank you again for your help.

    Hello VJ folks,

USCIS received my application on June 20 2023 and started actively reviewing my Form I-130, Petition for Alien Relative on August 16 2023. When I log into the portal, under myProgress it states the estimated time until the case decision is 12 months as of today (yesterday it stated 9 months).

When I look up processing times for service centers and this category it states 80% of cases are completed within 14.5 months.

Additionally, if I enter my receipt date it states…”The earliest you can submit questions is April 16, 2025. Please do not contact us before this date. We will notify you if we need any additional information. We appreciate your patience while we review your case. Processing times may change – return to this page regularly for updates.”

Lastly, why would an applicant have to wait almost 2 years to submit a question to USCIS?

Any feedback related to any of this would be appreciated.

    Respectfully,

I recieved a letter from USCIS wanting proof of evidence of our marriage, I was at 4 months, They received the proof and it went up tp 5 months, later that day my application was approved and case closed.  This happened last thursday.  As I was told when my dates kept changing from 1 week to 5 months not to be concerned with those dates.  I applied May 28 2023.

  3. My spouse is in the Philipines waiting for her spouse visa.  I received a Request for Evidence letter from USCIS.  They want evidence of shared bank accounts, share housing contracts ect...  She has never been to the US, I tried to sign her on to my bank accounts and with out a SSA they can't. My tax preparer didnt put me as married since she isnt here and no SSA.  We were able to add her as my military dependent at the VA in Manila.

Is there a way I can get her a SSA while we are waiting for the Visa?

On the items they want shared contracts I wrote in the letter why she isnt on them.

    Thank you for any help.

If she, as a Filipina, gets approved for a tourist visa, while having a pending spousal, please update us here because it would be the first that I've heard of, and I would be looking out my window for flying pigs.

I was just going to ask for any advice on applying for a spouse tourist visa.  There is a drop down screen asking what type of tourist visa I am applying for, spouse was listed, when i tapped it, it asked for my USCIS account number, I didnt have it at the time, I have it now, further down it asked for her passport information, we just got that today also.  So I'm ready to apply for it unless i get advice from here that its not advisable.

I got married in the Philippines to my wife. Marriage is recognized everywhere. No need to remarry. Your finance will not be able to get U.S passport just because she is marry to you, she needs to be naturalized as U.S citizen. sounds like the person giving this advice is a scammer or does not know

There is no legal shortcut to get her over here. However, when I did it there were ways, you could speed up the process once your petition was at the national visa center but that was to speed up the time a little. It did not bypass any requirements

Once I get my USCIS account number abd she recieves her philippine passport i plan to apply for a tourist spouse visa in hopes she can wait in the states while her spouse visa is being processed.  We understand that she will not be allowed to work during that time.

I don't think she is going to be able to pull off a US passport either just because she married you. I agree you can add her to your insurance, bank accounts, and things like that as a married couple. I also agree you don;t have to get married again in the US, your marriage if legal in Manila, will be legal anywhere else in the world. Why would they even have a CR1 visa if you could just marry a foreign national and get them a passport at the embassy. I wish I would have known this and avoided 4-5 years of K1, AOS, Removing of Conditions, and N400 filings. Would have saved me Thousands of dollars also, I would double check on the US passport thing, and if it's possible, post back and let everyone know.

Good news is, you got the hard part done and started the clock on the marriage, that means it will be an easy 2 years before she can enter on her visa( They are taking 18 months or so, and you haven't even filed yet), and she will avoid removing conditions and go straight to 10 year green card. SO you should have no issues entering after your 2 year marriage date. And if it processes faster, suck it up and wait the extra few months to get past the 2 year mark, and she will enter on a IR1 if memory serves instead of a CR1.

thanks for your input, im finding out she cant get a us passport, why i was asking, i dont want to make the spouse visa any harder than it is. I heard the embassy can process the visa if they want to, im working on that too, im not trying to do anything illegal, just looking for a legal backdoor that is publisized if you know what i mean, we had a long wait to get her annulment done due to covid, then it took us 5 months to process the paperwork to get the decree. I will ask if there is anything we can do to get the embassy to process it, if not, ill fly home and send the application in, it is ready to go.  Thanks for you comments.  If i find anything out, ill post it.

Is she an US CITIZEN? How can you apply for a US passport for her?

She doesn’t have the rights to obtain an US Passport just because she married you.

About this point: I need some advice on this, he also said I would need to marry her again in the US

Not true! Your marriage is valid in any other country if was made based on the local laws.

Please, explain your situation better because what you are planning is not right

    .

Look the Guides here on VJ and on the USCIS website. You both need to educate yourself about this process.

If I knew the answers I wouldnt be asking the questions.  I stated that we need to apply for a spouse visa using the I-130 I-130a applications. I am trying to find short cuts that are legal and wont hinder the spouse visa process, this is why I am getting advice.  I dont know where else to get information at this point.  We have an appointment tomorrow to sign her up for military benefits at the US Embassy VA office in Manila, I will ask there also and then see what we find when we try to apply for a US passport at the US Embassy in Manila next week.  Everything we do is legal, we will not lie on the applications.  We are married and I would like to take her home with me while we wait for her visa. Thanks for your input.

  8. Hi, I married my Filipina finally, we have an appointment at the Manila US Embassy VA to enroll her into military benefits May 25th, and an appointment to apply for her US Passport at the Manila US Embassy on June 5th.  While at the mall I was talking to a US Citizen who told me I could take my filipina wife to the states  on a US Passport then send in the I-130 and I-130a applications from the US.

I need some advice on this, he also said I would need to marry her again in the US.  If anyone has information on bringing her to the US using her US Passport it would be greatly appreciated.  I dont want to break any laws that would could enfringe on getting her visa processed.

I have recieved good advice from VisaJourney members so far and appreciate all your help.  We just finished getting her annulment decree through the system which only took us 5 months.

Once I get through this process and have a better idea about it through my experience, I will be sharing my experiences and help answer questions.

Thank you any information about taking her home on a US passport before turning in the I-130 application.

You mostly have your answers already, but I'm wondering how she got legitimate job offers.  If the offers are from people you know, and who know nothing about work visas, and/or just want to help you out, then they are irrelevant.  On the other hand, if these are legitimate job offers related to her special skills and a work visa is in the works, directly related to those job offers, then she could proceed with that visa process instead of the spouse visa process.

For example, I have an American friend whose Pinay wife (Registered Nurse) is seeking a special work visa, instead of a spouse visa.

    Please clarify.

The jobs are legit from assoiciates that do have a job for her.  We have an appoint at the embassy May 25th to enroll her for military benefits, we are going to see if there is some type of back door we can use to get it done, if not then i will send the application in through normal channels.  I dont think it will take that long, less than a year.  So that is our plan B.

  10. Hi, finally got the annulment decree.  We are planning to marry May 20th in the Philippines.  She has two job offers in the US starting this summer and I have a residence in the Philippines and another in the US.  From what I understand the embassy could accept to process our I-130.  How do I ask the embassy if they would process our visa?

    Thank you for your help.

  11. I have been the camp host at Honeymoon Flat since 2016, I'm not going to be able to make it this year for opener.  They arent sure when it is going to open due to all the snow.  My goal for coming here is to get married, I cant believe how long and the hassle it is to get the final annulment document,  We went to the statistic center yesterday to check on it and was told to come back on April 21st to pick it up.  After that we can start the marriage process, I hope its no as complicated and time consuming as the annulment.  Once we get married I can get back to my camphost job.  Luckily, my 5th wheel is parked in Smith Valley NV 55 miles north off 395.  If youre ever in the area, stop in sometime and say hi.

    Thanks for the advice.

Hi, I am not sure if I have any more info that is useful since other posters have already given good answers and advice.

I married my wife in the Philippines in May 2014. I did fill out the contact to legally marry and made an appointment at the us embassy in manila to get it notarize, that is the reason you go to the embassy, but I read another post you can go to other notarize places in the Philippines that might be better I do not know. When I did it you had to go to embassy

after you get that notarize you can go to the civil building, we went to the one in Manila as that is where my wife was living at the time.

They go over your info and depending on age of your fiancé there. There are requirements I just do not remember exactly. But bring extra money.as they will drop the extra requirement.

Then it took about 10 days to get the Marriage license, after you getit,t you can marry anywhere in the philippines. I was little worry as I had 15 days in the philippines

We got the Marriage license and flew to Bohol from Manila. We got married at her parents' house. The mayor of the town they live in officiated the wedding

Just make sure your trip there is at least 15 days to be able to get Marriage license in time. Also, ask for rush on NSO marriage License as that is what they require for I-30 visa. I did not and got aRFE return for evidence I sent in the local Marriage certificate instead of the NSO as that is what I had when I submitted info for I-30. I   had to request a copy from the NSO in the Philippines for a copy of the Marriage certificate

    Congratulation on your future wedding

    best wishes

We went to the statistics center yesterday for the annulment decree, they said to return on April 21st.  On the affidavit, I can have it notarized anywhere now and the annulment doesnt need to be publicized as her lawyer kept telling us that it was needed.

Thanks for all your info and advice.

Since we will be in Manila tomorrow, we will stop by the embassy and inquire about it.  All the can tell me is no.

Wife's interview was today.  15 minutes and recommended for approval.  Friendly officer with standard questions.  No documents asked for.  Officer said oath ceremony should be in about 45 days.  All good so far!

Wow, congratulations, thats great.  I hope it all works out.  Is she keeping her Philippine citizenship also?

That no longer needs to be notarized by the Embassy.  ANY notary in the Philippines can notarize it.  The relevant Philippine rule is here.  https://psa.gov.ph/sites/default/files/MC NO. 2021-04 Local or Philippine Notarization of Affidavits in lieu of Certificates of Legal Capacity to Contract Marriages.pdf It covers all nationalities but it includes a US Citizen specific example on page 3.

Thank you for the information, I had a copy of the Affidavit in Lieu of letter, I liked the one you sent me better, I was able to fill it out on the computer and print it.  We will visit the stastics center next week and I will find out for sure where I need to have it notarized.

Thanks for your advice, much appreciated

Yes.  Because, and ONLY because I could prove I was both a US and Philippine domiciliary, we were able to file directly in Manila.  It was a huge time-saver for us.  See pages 5-6 of the Form I-864 Instructions for pertinent domicile conditions.  Feel free to PM me if you wish.

Hi, I have been making the house payment here since jan 2020, it was part of our agreement so she could come home and get the annulment. The house is in her kids name, she is buying it for them. I have receipts and bank statements that show withdraws at philippine ATMs to make the payments.  I looked at form I-864 and it is talking about tax records which I dont have any deductions for either of my homes.

I am not very familar how visajourney works, how do I PM you?

    Some points:

    1. Marrying in the Philippines: you can choose to get married the traditional way (with all the tedious paperwork involved) or through the Utah Zoom process, which is much faster and is recognized by US immigration. Plenty of VJ threads about the Utah Zoom process.

    2. Spousal visa: since your future wife lives in the Philippines, there is no other option but to go through the US embassy in Manila for her immigrant visa. I noticed you mentioned a "I29" application in your post. I assume you mean an I-129F petition. That is only for fiances. If you submit a I-129F petition and then get married, you automatically invalidate the petition and it would be a total waste of time and money.

    The correct steps are:

    - finalize the annulment

    - get married

    - start the spousal visa process by filing an I-130 petition

The rest of the steps you can find using the guides on this site.

    3. Timelines: unless you have special reasons to qualify for expedited processing, your future spouse will not receive a spousal visa in time for summer 2023. It's more realistic to plan for the visa to be granted in 2024. You can check VJ timelines for data from other users who are waiting for their immigrant visas from the US embassy in Manila.

Thank you for your advice, yes i meant a I-130, I also filled ut the I-130 a and attached it to my application. All we need now is the annulment and then the marriage license to move on.  We will see if the embassy in Manila can process the visa for us once we get married.

    Thanks again, Dan and juliana

Obtained spousal visa in the Phils.  Because I had simultaneous domiciles in the Phils and the US (and we lived in the Phils at the time), our application was processed by the Manila Embassy in a few months.  The Embassy folks were great.  We came to the US in 2019.  Her interview for naturalized US citizenship is tomorrow.  She's well prepared.  As you will be for your permanent resident visa process.

Speaking as a former Nevadan, I think your bride will enjoy the views form Minden/Gardnerville. Mine did.

Congratulations on her citizenship interview. Let me get this straight, you didnt have to go through the normal spousal visa, you were able to use the manila embassy because you were living here? I have a domicile here and in Nevada, so I can go through the embassy and get her visa?

I have a camp host summer job in Bridgeport CA, if we can go through the embassy I will stay here and get it done, They will hold my job for me.  I hope we can stay in touch, I really appreciate your knowledge and help.  I will inquire at the embassy when we go there for the notarization on monday.

My wife had been single and never married when I met her.  I'm not informed about I-29.  It's not too early to start thinking about arranging the date of your marriage ceremony, whether at a regional trial court or otherwise.  As you might suspect, getting a quick wedding date in the Phils, once all the necessary documents are in hand, is not easily done.  Recognizing that you're in a time squeeze, I think an attorney who is well-connected with your local regional trial court might be of assistance.

We got the list of what doce we needed and have all of them together.  The one you helped me with was the last one in question.  We have a minister lined up to marry us when we are ready.  Getting everything filed could be another problem.  I dont need to be here for that, she can get that done on her own.

Did you take your wife to the US? I-19 is the spouse visa application.

  20. 17 minutes ago, Mountainside said:

You don't need a ds 5542.  You need an affidavit drafted by yourself or an attorney, stating that you're eligible to marry in the Philippines.  That's what you'll take to the Embassy for notarization.  I assume that your fiancee has an attorney who helped her obtain her annulment, who can easily draft such an affidavit.  If not, and if you're unable to draft such an affidavit, hire a lawyer to do it.  As legal documents go, it's simple.  Make an online appointment for the Embassy selecting "notary services - other".  Then show up, get it notarized, and leave.  Only takes one visit.

Thank you for clearing that up.  I do have a form for that purpose that i will take down to the embassy in manila next wednesday.  Did your wife have to go through an annulment?  I hope not. it has been a nightmare getting the right forms signed, original copies made waiting here and there days for a return and we think we got it and something else pops up.  Our package just got to the statistic center in manila and that is upto a 15day wait before we can go and pick up her final decree so we can move on. I think we will stop by there when we go to the embassy and see is we can get them to give us the document.  I want to get married before i go back to the states so i can send the I29 application in. Just need the annulment decree and marriage license.  If you have any suggestions on the I29 app I would like to hear about it.

Thanks for all your help.  I will share anwers once i get through this experience.

Appear at the US Embassy in Manila (or the consular office in Cebu City, if it's closer to you) as per this State Department link, with an affidavit to be notarized/authenticated:  :https://travel.state.gov/content/travel/en/international-travel/while-abroad/marriage-abroad.html

That's what I did and it worked for me.

Thank you for the information.  In the marriage section of form ds5542 it asks for date of marriage, we havent been married yet, we are preparing to get married. What part of the form do I need to fill out for permission to get married?

    Thanks again
