  1. Thank you so much! He will be doing it himself this time around.
  2. So I think I might know what the issue is. My cousin used a preparer to file. So he got an RFE for I 130 and I 485. I 130, a RFE was for I 130a and I 485 was for for a buch of items. We believe the preparer only sent the RFE for the I 485. We can see on the USCIS website they received the response for the I 485 but none for the I 130. So can he go ahead and file a new petition? Must he wait awhile or he is allowed to put in a new one immediately? Thank you everyone.
  3. It is denied as well. They were actively reviewing it on September 12 and on September 12 they canceled their notice for RFE. It is denied as well. They were actively reviewing it on September 12 and on September 12 they canceled their notice for RFE.
  4. He got married prior to the visa expiring but he file after the visa expired He was married prior to the visa expiring and filed after visa expired.

  6. That's what I thought too but I am not sure what happened to the I 130. It might be the RFE? They canceled the RFE on September 12 and he got the denial of the I 485 on September 24.
  7. He entered on a tourist visa. His spouse petitioned for him.
  8. Hello, A cousin of mine had his i-485 denied. Reason is he did not have a pending or approved visa petition. He filed the I 130 concurrently with the i_485. He got an RFE which he sent and it was marked as received by USCIS. They canceled the RFE on September 12 and 2 weeks later he was denied. What can he do now to rectify this situation? I have attached a screenshot of the denial letter. Thank you in advance!
  9. Hello Oko, has there been any update? I also got the same letter which stated that my claim has been disallowed because my spouse’s SSN was issued after the return was due and I cannot retroactively file MFJ.
  10. Thank you. They divorced prior to meeting his current wife. He married the current wife in 2019.
  11. Hello, A friend went for a spousal interview and was given a paper with section 212(a)(6)(C)(1) marked as the reason for the refusal. He is eligible for a waiver. In 2011, his then girlfriend won the dv Lottery and they got married after. The CO denied the visa because she didn’t believe they were genuinely married resulting in a section 212(a)(6)(C)(1). Does he need an immigration lawyer to file the 601 waiver or he can do it himself? Thank you.
  12. Lol. Thank you. So the petitioner is filing for the mom and asked the dad for the divorce date. A divorce certificate was not submitted with the I 130. USCIS didn’t catch that. NVC requested for the divorce certificate and that’s how the petitioner realized there was a mistake with the date when petitioner reviewed the divorce certificate. Since it is Ghana, I suggested an affidavit to proof the correct date is the one on the divorce certificate and the one on the I 130 and ds 260 was a mistake when the mom goes for the interview.
  13. This is an IR-5 case not IR-1. Asking for relative. Thank you.
  14. Hello, The divorce date was incorrect on the I 130 and on the submitted DS- 260. NVC requested for the divorce certificate and it was noted the divorce date was incorrect. Divorce certificate has not been uploaded to CEAC yet. What can be done to correct this error? Thank you.
  15. Thank you. However, On the USCIS website, it states the filed I -130 automatically turns to I -360. No idea how to go about it. Who should be contacted at this point ? NVC? The embassy?
