Just a quick update, my for N-336 was submitted July 15. My oat ceremony was scheduled today and my N-336 form has been closed. I’m glad I followed my gut and submitted the appeal.

Denial is a Service Error as nothing in the statute prohibits filing for naturalization while physically outside ( like for example a rentry permit )For naturalization , temporary travel does not invalidate one’s established domicile/residence and you clearly meet all the residence and physical presence test.
That’s what I plan on doing because I strongly believe they made an error. I contacted a lawyer to help me with the appeal. It just really sucks that I’m the one paying for their mistake. Thanks

My worry is that if I submit a new application, they might deny it again. But with the appeal, they could properly look at my case and see that they made a mistake. I tried contacting a lawyer for advice on what to do. It’s frustrating how they deny without proper proof

I submitted my N-400 on April 10 2024. I passed my interview on July 1st but got denied today. For the following reasons
On July 9, 2021, you was admitted as permanent resident in immigrant classification IR1.
On July 1, 2024, you appeared for an interview to determine your eligibility for naturalization. At the interview, you provided testimony under oath. During your interview you stated that you traveled outside of the United States on April 9, 2024 and returned on April 24, 2024. That you visited Nigeria. Additionally, you stated that you filled your Form N-400 on April 10, 2024, while in transit in Istanbul.
After reviewing the evidence and the testimony provided at the interview, USCIS records indicate that you are ineligible for naturalization the following reason(s):
During the interview and review of your application with an Immigration Services Officer, you confirmed that you resided at…… from February 9, 2023, to the time of filing your application on April 10, 2024. In order to qualify for naturalization under section 319 of the Immigration and Nationality Act, you must reside in a State or USCIS Service District having jurisdiction over your application for at least 3 months before you may file Form N-400. USCIS records reflect that you were outside the United States preceding to the filing of your Form N-400. Unfortunately, ineligible for naturalization at this time.
You were outside the United States preceding to the filing of your Form N-400 For this reason, you are ineligible for naturalization at this time. See section 319(a) of the Immigration and Nationality Act (INA).
You have not established that you are eligible for naturalization under section 319 of the Immigration and Nationality Act (INA). Therefore, for the reason(s) stated, we must deny your Form N-400 application. If you believe that you can overcome the grounds for this denial, you may submit a request for a hearing on Form N-336, Request for a Hearing on a Decision in Naturalization Proceedings, within 30 calendar days of service of this decision (33 days if this decision was mailed).
See Title 8, Code of Federal Regulations (8 CFR), sections 336.2 (a) and 103.8(b). Without a properly filed Form N-336, this decision will become final. See section 336 Immigration and Nationality Act (INA).I have resided in my current residence more than a year to day before filing the form
I was only on vacation to my home country for 2 weeks. I don’t meet the requirements for denial.
I want to submit an appeal but it will cost around $780, can I get my appeal money refunded since the uscis officer clearly made a mistake?

I had it done at Aga khan University hospital, had it done around 9am and got it back in the afternoon

Yes, they asked for COVID test like 5 times before getting on the plane, you can’t leave without it..

Hello everyone,
Just wanted to sayI entered the US yesterday and everything went smoothly, I picked up my passport Thursday and left Thursday night.
It feels good to be back home and be finally over with all this.
Wishing everyone else waiting in this journey good luck, it will all be over soon 🤞

They finally updated my status yesterday to issued so I’m hoping to get dhl tracking today.
Looks like everyone who got approved here have got tracking number next day after their status changed to issued

We were told by our Senator that my visa was issued on Friday and that I’ll get dhl tracking this week, I was hoping to get the dhl email but up till now nothing.
Does anyone knows how long it takes to get dhl tracking once visa is issued?
Is there any hope of me getting the tracking today or it’s too late to get it today?

It shouldn’t take long after the medicals before you get appointed, in my case it was two weeks after the embassy got my medicals.
I have been in Kenya since August last year and my case was expedited on September, my son is about 10m old and I’m still waiting for my so called visa for a case that was expedited last year.
Just hold on, every case is different and once you’re done with medicals then hopefully you get interview soon

That’s a long time especially for an expedited case but really I’m not surprised the Nairobi embassy will do this.
There’s a website she has to sign up for for document returns and all, that’s where I submitted an expedited interview date and wrote my situation in details and they gave me an earlier date, there’s no harm in trying that, hopefully they’ll approve and give another date

I don't believe Nairobi is doing any CR1 VISAs by normal processing. Any CR1s are expedite only. Any spouse VISAs they issue via regular processing will be IR1 because of how far behind they are.
The May VISA reports are also not out yet.
All of this is very frustrating.

I really thought it was finally over when they asked for my passport but it looks like issuing the visa is taking longer than expected.
I think Nairobi embassy is one of the embassies that are not very slow, I hope for everyone who’s waiting that we hear some good news soon.

The US embassy has refused to issue my visa, all they keep saying is keep checking ceac and you’ll receive a dhl tracking number soon once visa is issued.
What they mean by soon I don’t know, it’s going on two weeks now since they received my passport.
Has anyone experienced anything like this?
I’m losing my mind here

CEAC update should be a good sign.
I was placed on AP for about 90 days and when case started to update often was when they were done with AP and I have now sent my passport to the embassy, it’s been a week since they received my passport but nothing yet.
Last update was Friday and case still shows refused.

It was two weeks prior to the interview date but then I wrote the consulate and told them that my case was expedited and that it took the embassy two weeks to finally say they get my medicals from IOM, I requested for an earlier date and they gave me a week earlier.

The Nairobi Embassy reached out to us to do the medical and asked us to respond back to them once its completed to get the interview date.
My mother completed her medical on June 23rd and per IOM, they sent the report over to them on June 24th. We have been trying to email the consulate for the interview date but we are getting no response at all. Do you guys know how long it takes to get an interview after the medical??
Thanks in advance for your help!They respond to emails when they want and sometimes they lie that they’re waiting for the medicals from IOM even though IOM has already sent it, they’re always so lazy to go through their mail and see what was delivered but don’t worry, you’ll hear something soon because they can’t drag it forever.
My case was expedited too and I’m still waiting for my visa to be issued
I got my interview about two weeks after medicals and that’s because the embassy will not do their job

I’m not sure what’s going on with the US embassy Nairobi but I have noticed they’re very slow and don’t do their work.
it will be 1 week tomorrow since my passport was delivered to the embassy and up till now my visa has not been issued.
I don’t know if this is a punishment or something but I think whoever is in charge is very mean and have no idea how what they’re doing is affecting families.
I can’t even breathe anymore, I feel like I don’t want to even go live in the US, been there twice and it’s no biggie, if not for my son, I’ll give up this whole thing and move on with my life somewhere else.
This is totally unfair how they treat people, there’s no reason whatsoever now why my visa hasn’t been issued, they don’t reply to emails and when you call they ask you to send inquiries via email.
The embassy can do better and stop keeping families apart for their own selfish reasons 😡
