I-129f (Part 2. 49.a. through 50.f.)
JeanneAdil replied to Katnissmjy's topic in K-1 Fiance(e) Visa Process & Procedures
from USCIS I 129 instructions https://www.uscis.gov/sites/default/files/document/forms/i-129finstr.pdf Item Numbers 47.a. - 48. Your Beneficiary’s Physical Address Abroad. Provide the address and daytime telephone number where your beneficiary currently resides abroad. \ Item Numbers 49.a. - 50.f. Your Beneficiary’s Name and Address in His or Her Native Alphabet. If your beneficiary’s native alphabet does not use Roman letters, provide his or her name and physical address abroad in the native alphabet. Otherwise, skip to the next question (Item Number 51.). i would say the operative words here are "where your beneficiary currently resides abroad" but Nolo legal says Questions 49-50: If the visa applicant's native language uses a non-Roman script (for example, Russian, Chinese, or Arabic) write the name and address in that script. -
It will be up to CO and how they view all circumstances especially when so many beneficaries support family back home Do not know if China looks at bene fiancials / best to move post to China for best answers
-
please do a timeline as it helps others from ghana to know answers for this embassy
-
sorry but i should say the CO doesn't talk about money like how can he travel if no income / what they ask many bene's is "Who paid for the trip?" its the same question with a different approach
-
fiancee needs to be prepared for extensive questions concerning your income for public charge issues 1. how can u pay for health care for finance? 2. she can not work on K1, so how will u live? 3. how could you pay to travel to meet her if no income? 4. how will u pay for the AOS after US marriage? now costs is $1225 possibly going to $2820 5. will joint sponsor help (as really joint sponsor is to protect the government) these are hard questions that may be asked because of bene sorry, not trying to be mean but its important to understand how this can be viewed by a CO

An IRS Verification of Nonfiling Letter (VNF) will provide proof from the IRS that there is no record of a filed tax form (1040, 1040A, or 1040EZ) for the year you have requested. A VNF does not provide proof that you were not required to file, only that you did not file. For any academic year in which your FAFSA is selected for verification and you reported “Will not file,” you will need to request a VNF for the prior-prior year (eg. for 2019-2020, request a VNF for 2017). Non Tax filers can request an IRS Verification of nonfiling, free of charge from the IRS in one of three ways: Online Mailing in a form Make an appointment at your local taxpayer assistance center.

K-1 AOS RFE

The long form should have the raised seal to show at interview/ it has to be the exact one u send to USCIS (i know it says 90 days expired but don't worry about that part) -
NVC does not give instructions for K1, follow the guides Once you receive the notice from the NVC, you need to complete the State Department’s online DS-160 form: Online Nonimmigrant Visa Application. This is the actual K-1 visa application. After you complete this form, you need to print the confirmation page. This is very important because you will need to send the confirmation page to the embassy and bring it to your visa interview. Cases are on hold till ds 160 is done at this point embassies differ on how they handle K1/ check your embassy web page as some let u schedule the interview and other embassies do the scheduling

We do not know your circumstances so its hard to say Only guessing the cost of health insurance is a big issue If this is a spouse visa and will have children also coming (or is of child bearing age), adding a spouse to employer insurance under family plan is high Examples come from Money geek The average cost for a 40-year-old couple is $1,077 per month or about double the cost for an individual in that age range. On the other hand, a 40-year-old couple with one child under age 14 would pay an average of $1,398 per month, and a family of five would pay around $2,040. If this is for a parent or parents , u will be expected to pay out of pocket for the insurance from marketplace (u would need to find out the cost) USCIS has a pretty good idea of this based on charts they use https://www.healthcare.gov/choose-a-plan/your-total-costs/ other factors : gaps in employment history short length of time with a company (or all companies u have worked for) pay out of alimony and child support that depeltes "living income" cost of living in your area Example: NYC and Miami are far more expensive than countryside of SC, TN, AR current job is new will the income continue at current rate or is petitioner close to retirement the following site (although updated last in 2015) has some good types on what NVC looks for and mistakes made on I 864 https://www.cliniclegal.org/resources/family-based-immigration-law/five-most-common-mistakes-completing-i-864

ask the USC to come to be an emotional support for interview CO usually asks when u last were together and if the bene could say "he's here now" that would be good if USC and bene can be together again before interview , its always good
-
USC needs to correct this for immigration as married not single hard to prove to a C O at embassy that a marriage is bona fida if u put single on the tax return for the year u are married
-
Yes, CO will put case in AP while they wait for the current (2022 after 15th of April ) to get to embassy and then the CO still does not act fast on the case / the embassies seem to take their good sweet time but if u send in late to embassy, make sure the case # is on all 10 pages of your IRS transcript , ID both names and DOB's for the Case and yeah i know name is on returns BUT CO will not make things easy

i think the embassy is harder on K1 my gf Cris was granted CR1 also but husabnd was a Dr and they came before covid when things went a little faster -
yes, if u don't have the current tax year ( 2022 after the 15th of April , CO will put case in AP while they wait for u to provide the tax Transcripts (IRS 10 pages of copy of 1040 with your W's and whatever else the CO requests) Remember to put case# ID the names and DOB's on all documents sent to embassy/ , yeah , i know USC name is on the tax forms but don't expect CO to make it easy by putting them with right petition if case # isn't on them And the embassies have been known to work slow even after the needed documents are received And u are trying to prove married , filing single is not the right way to show embassy, u r married

i got my SS survivor benefits after husband passed away as he was receiving SSA i didn't qualify for my benefits until then as i was not of retirement age to recieve my own Its the first paragraph and she doesn't talk about having a child under 16 When a worker files for retirement benefits, the worker's spouse may be eligible for a benefit based on the worker's earnings. Another requirement is that the spouse must be at least age 62 or have a qualifying child in her/his care. By a qualifying child, we mean a child who is under age 16 or who receives Social Security disability benefits. When a worker files for retirement benefits, the worker's spouse may be eligible for a benefit based on the worker's earnings. what benefits are u writing about? you say the 2 of u want to travel in and of the US spouse visa to qualify for becoming a Lifetime permanent resident (LPR) and living in US 5 years is the best way to go monthly payment? if USC is getting SSA , u qualify as follows for survivors benefits when USC passes away Can a non resident spouse receive Social Security benefits? In most cases, the answer is yes. Foreign spouses generally qualify for Social Security survivor benefits, which are the deceased US worker's full benefits. In the case of dependent or spousal Social Security, a foreign spouse will likely qualify, receiving half of the US expat's benefit. and since Singapore does not have a tax treaty with the US , SS would take 30% flat tax out of your SS payment https://www.irs.gov/businesses/international-businesses/united-states-income-tax-treaties-a-to-z S Slovak Republic Slovenia South Africa Spain Sri Lanka Sweden Switzerland For medicare, USC can try to apply but medicare only pays for emergencys outside the US https://www.medicare.gov/Pubs/pdf/11037-Medicare-Coverage-Outside-United-States.pdf

Healthcare Worker EAD Expedite
JeanneAdil replied to SA21's topic in Working & Traveling During US Immigration
Have u passed the tests in USA for certification or documents necessary for work in your profession? -
If she was in US , the I 130 would accompany the I 485 and other forms for Advanced parole (I 131) and EAD (I 765) unfortunately USCIS uses the same initials for different processes AP can be advance parole or adiministration processing AOS can be adjustment of status (i 485) of Affidavit of support for CR1 (I 864) Yeah and a K1 is non immigrant visa but on CEAC site u look up case status an immigrant Confusing , yeah
