He can answer what he knows as good as he can in either language If he can, tell him to use English when he is sure of the English word and his native language when he needs to some just do in native language for the whole interview this is not a high fraud country so not as big an issue as one like mine

Every 2020 w2 and 1099
JeanneAdil replied to val lavengco's topic in National Visa Center (Dept of State)
It would be best if the USC was here so he could respond to VJ queries and get the needed help for instance there are 21 different 1099's including at least 1 we t ax payers have to create for ourselves the others have a copy sent to IRS like our W2's from the employer and our info sent in with 1040 must match what the employer reported if he is self employed , he may have a 1099 -NEC he has not included or SSA 1099 as it could fall under non taxable so, get the USC on here for real answers -
Consular processing question
JeanneAdil replied to stunna2018's topic in Bringing Family Members of US Citizens to America
Because u did not post what visa she was going for and as an LPR, you couldn't apply so, this might have been tourist visa which is usually 10 year but time in and out of USA is also important for a tourist and to get the right answers , its important -
the letter saying no taxes filed needs to come from IRS which can be asked for online and if petitioner has no income , the USC needs a joint sponsor An IRS Verification of Nonfiling Letter (VNF) will provide proof from the IRS that there is no record of a filed tax form (1040, 1040A, or 1040EZ) for the year you have requested. USC can follow directions online to get the VNF on the following site. https://www.eou.edu/fao/how-to-request-irs-verification-of-non-filing-letter/#:~:text=An%20IRS%20Verification%20of%20Nonfiling%20Letter%20(VNF)%20will%20provide%20proof,that%20you%20did%20not%20file.

Consular processing question
JeanneAdil replied to stunna2018's topic in Bringing Family Members of US Citizens to America
profile says you are just a LPR and no timeline to say if u r only that or have become a USC so, as LPR, u can not apply for her to live here so, is this a B1/B2 tourist visa? or did someone else apply for her green card? there are several different senerios but coming and going will be highly suspicious by CBP Ideally she should not stay out over 180 days as an LPR with green card ,she has to file US tax returns Can you stay outside of the US for 6 months? If you plan to stay outside of the United States for more than one year but less than two years, you will need a re-entry permit for readmission. You must be physically present in the United States when you file the Form I-131 to apply for the permit. -

Work Denied even though valid to work
JeanneAdil replied to JPWJ's topic in Working & Traveling During US Immigration
she is not even required to show her green card Go to this USCIS site and print it out and take to employer https://www.uscis.gov/i-9-central/employee-rights-and-resources/employee-rights#:~:text=Your%20employer%20must%3A&text=Allow%20you%20the%20choice%20of,Nationality%20Act's%20anti%2Ddiscrimination%20provision. Your employer may not: Ask for specific documents because of your national origin, ethnicity, immigration or citizenship status, race, color, religion, age, gender, disability, or genetic information, or because of any other protected characteristic. For example, your employer may not: Ask for a document issued by the Department of Homeland Security because you are not a U.S. citizen. Ask for a U.S. passport to prove you are a U.S. citizen. Refuse to accept your document or refuse to hire you because of an unfounded suspicion that your documentation is fraudulent. For example, your employer may not refuse to accept your identification and unrestricted Social Security card because you have limited English proficiency. Treat you differently than other applicants because you have, or your employer believes you have, a particular citizenship or immigration status. Ask to see documents showing your permission to work before hiring you, or before you complete Section 1 of Form I-9. Refuse to accept your document or refuse to hire you because your document expires in the future. -
she has to apply and prove she will return to Egypt with a spouse visa in the process , chances are the tourist visa will be denied

RFE for I-864
JeanneAdil replied to Dimmiq's topic in Adjustment of Status from Work, Student, & Tourist Visas
You have submitted Form I-864, Affidavit of Support, from the petitioning sponsor. We are unable to process the I-864 because it has one or more deficiencies. In order for us to process your application further, you must: Submit a completed and signed Form I-864, Affidavit of Support, from the petitioning sponsor. All pages must be present and of the latest edition date. the deficiecieny would be not the lastest I 864 form and income for 2022 and proof of tax return Provide the petitioning sponsor's Social Security Number on Form I-864. Provide a complete and correctly calculated household size for the petitioning sponsor on Form I-864. Submit a complete copy of the petitioning sponsor’s Federal income tax return, including all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules) filed with the return, for the most recent tax year. This is what they need /an extension only delays the NVC process while they wait for u to send in 2022 Note: Applicants using a family member's visa petition to adjust status must be listed as a family member on the principal immigrant's Form I-864. -

we can not say about an approval but u asked our opinion and without knowing any other info that would be considered as a red flag, u don't have a strong case because of lack of quality time spent together and yes,a previous denial of a K1 does not help your case. CO did not have to ask u about the K1 , all the info was on a computer in front of the CO BTW CO can deny a petition for any visa at any time my k2 was denied i married and then 1st CR1 was denied so, been there ; had that done to me -

Did the CO keep your passport? your AP will probably be a long one before u hear approved or denied? Covid was 2020/ we have been able to travel since 2021 when fully vaccinated Nigeria opened back up according to the following April 2020 Hon. Minister @hadisirika glads to announce the resumption of international flights from the 29th of August, 2020. Beginning with Lagos and Abuja as did with the domestic flight resumption there was no Presidential election 2021 /there was only a state election to fill empty House of Assmebly empty because of a death 2022 and 2023 February elections were tumulutuos but the country has always been reported by the State Department to be dangerous for USC to visit / CO's know this as they receive all the warnings and its posted and has been posted for decades so it was unsafe when she came and meet and married. Reconsider travel to Nigeria due to crime, terrorism, civil unrest, kidnapping, and maritime crime. Some areas have increased risk. Read the entire Travel Advisory. There was no good excuse not to meet again and the case looks weak MY MIL visited us from Moroc after covid
