DIvorce in NYC
JeanneAdil replied to vamphog's topic in Effects of Major Family Changes on Immigration Benefits
It is a requirement you are not legally separated and the following is from NY Bar for "No fault " divorce If the lawyer wanted $5000 he might have been going for "grounds" for divorce for inhuman treatment and that's more intense https://nysba.org/legalease-divorce-and-separation/#header1 The other (“no fault”) grounds are: one year of living apart under a separation agreement; one year of living apart under a separation decree granted by a court; an irretrievable breakdown of the marriage for a period of at least six months, provided that one spouse has so stated under These “no fault” grounds afford New Yorkers a basis to get a “no-fault” divorce, in which neither spouse is judged to be at fault. Unquestionably, the “no fault” laws will provide a disincentive for people who wish to challenge the basis for the divorce. -

JeanneAdil replied to Zongkeh's topic in Bringing Family Members of US Citizens to America
It would be the USC applying for the I 130 the following is from the USCIS site on adoption relative a so the USC needs to live with the child for 2 years https://travel.state.gov/content/travel/en/Intercountry-Adoption/Adoption-Process/how-to-adopt/adopting-a-relative-for-immigration.html#:~:text=Yes%2C you will need a,adoption services have been provided. INA 101(b)(1)(E) requires the child to have been in the legal and physical custody of, and resided with, the adoptive parent(s) for at least two years prior to filing the Form I-130 petition. If the child is or was habitually resident in a Hague Convention country prior to the adoption and the adoption occurred on or after April 1, 2008, the two-year legal custody and physical residency period generally must be satisfied outside the United States in order for the Form I-130 to be approvable. There's a lot of reading u need to do to understand all that is involved especially since the father is still alive /and i mean a lt of reading Very important to answer as others have asked "What country?" -

Second IR1 Interview at US Embassy, Accra
JeanneAdil replied to kwabena11's topic in US Embassy and Consulate Discussion
important to know when their medicals were dated/November date can be anywhere from 1 1/2 to 3 months ago they need to have visa and travel prior to 6 months of exam date so, if they expire , the CO will request new medical exam and it would have been a CO who did the 2nd interview -

K1 visa with medical waiver
JeanneAdil replied to monsterhouse's topic in K-1 Fiance(e) Visa Process & Procedures
Diabetes with a wound (even a hangnail ) often leads to gangrene and is very serious I have 2 cousins with diabetes who lost a foot and /or leg to a foot wound (one was just ingrown toenail) diabetic individuals should even go to dr to have nails trimmed and that is why this person has my prayers Swelling, blistering and a wet appearance are common features of wet gangrene. Wet gangrene may develop after a severe burn, frostbite or injury. It often occurs in people with diabetes who unknowingly injure a toe or foot. Wet gangrene needs to be treated immediately because it spreads quickly and can be deadly.Jun 17, 2022 -

don't marry if u lack the income to support the AOS you need to know the poverty income levels as u need to meet 125% of needed income for her to get green card thru a marriage $24,650 also know the cost of the AOS fees go up 4/1/2024 for this process Form I-485 (Application to Register Permanent Residence or Adjust Status), used by those seeking a green card or permanent residency, will also go up 18% for the standalone application (from $1,225 to $1,440). However, two formally free applications within the adjustment of status process, employment authorization, and advance parole, will now cost an additional $260 and $630, respectively. To keep her in the US it is costly

MFJ or MFS you are married so single does not work for MFJ the return must be mailed as the supporting documents for marriage must be originals 2. to do MFJ I got a POA from my spouse in lieu of him signing the return (so i could sign his name) and for IRS to send refund to my checking fill out the W7 with supporting evidence of marriage and her ID as per instructions on the following site as said above https://www.irs.gov/individuals/international-taxpayers/taxation-of-nonresident-aliens fill out the 2555 to exclude as much as $120,000 of the foreign income https://www.irs.gov/individuals/international-taxpayers/figuring-the-foreign-earned-income-exclusion#:~:text=For tax year 2023%2C the,the foreign earned income exclusion.
