  1. we didn't shred ours as we filed a petition for a brother and that takes so many years i would forget dates that will be needed later
  2. Life threatening is a hard one its like shooting yourself in the foot makes it seem u may not be around for the unification with the spouse She lives in Iran so u may be looking at long AP after the interview for additional security
  3. its just another form of photo ID plus proof of approved visa the receptionist desk is the only place u will show this sometimes 2 photos ID"s are required
  4. submitted I 130 in October 2022 so you have quite a while to wait after the 2nd phase at NVC , it will depend on whether u interview prior to April 15th 2024 or after 1. your passport 2. the original I 864 from petition 3. USC tax retrurns with W2's and any 1099's 2022 if before 4/15/2024 2023 tax returns if after 4/15/2024 4. USC proof of US residency 5. marriage certificate in native language and English translation 6. original birth certificate in native language and English translation 7. photos of the 2 of you with marriage and any visits 8. any other documents required per NVC/embassy mail for interview not from Japan but that's how we did it if u go to your profile and choose country flag, the post will be captured in Japan portal and others from your country will respond best to u both
  5. should always post this type of info as it makes a difference should complete a timeline on your profile and ID the country as it helps the VJ community answer your query
  6. https://egov.uscis.gov/processing-times/ The above is projected processing times for K1 in Texas if your case is trully there 16.5 months for a K1 hope ur case will go faster Be patient But Too soon to make any plans and never pay for a airline ticket or wedding venue till that visa is in hand after the embassy interview, the case goes thru AP for administration processing and may be days, weeks or months till u get a visa the best life to u both in the USA
  7. New Mexico is a state in the US / no border control unless u hit one of the border stations inside the state set up in high risk areas checking for illegals /like someone says "below I 10" U will go thru security at airport as we all do but when u get off plane in New Mexico, u don't go thru customs and immigration /ITS THE USA
  8. you still have to establish that US residency so when u come, get a DL and /or open bank account if u don't work (UK husband supports) send letter to IRS to show no tax return filed (this will be at the 2nd stage of process -NVC stage) u will still do a I 864 and will need to show income of 0 you will need joint sponsor to complete the income requirements and insructions for I 864 tell u how that works If mom can not qualify, u will need someone else Do you get a letter from IRS for not filing taxes? An IRS Verification of Nonfiling Letter (VNF) will provide proof from the IRS that there is no record of a filed tax form (1040, 1040A, or 1040EZ) for the year you have requested. A VNF does not provide proof that you were not required to file, only that you did not file.
  9. I wish immigration would stop using the term refused but that is the term they post till the entire process is completed and petition is either approved or denied Refused only means the case is going thru administration processing and u are waiting for a decision It's normal for all cases
  10. it also says asylum or refugee and the military recuiter may be able to help his asylum case and there are 2 many factors here that only the OP knows like how old he is how is his asylum case coming along does he have a clear criminal record in his country and in USA since arrival what is his education level and the biggee Has he registered for the draft • Virtually all men living in the U.S., including non-citizens, are required to register with Selective Service at www.sss.gov when they turn 18 years old. This includes undocumented immigrants, legal permanent residents, those seeking asylum, and refugees. https://www.sss.gov/wp-content/uploads/2020/03/Immigration-Attorneys-Toolkit.pdf
  11. USC needs to come to US and establish US residency you will be petitioner for spouse and any children and will file the I 864 so getting here and finding work is important/then your mom could be joint sponsor as this is what USCIS says If the petitioner does not have a domicile in the United States, can a joint sponsor file an I-864? No, the petitioner must meet all the requirements to be a sponsor (age, domicile and citizenship), except those related to income, before there can be a joint sponsor. https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/i-864-affidavit-faqs.html#aos9
  12. MAVNI program is not over War on Terrorism is from September 11, 2011 to present https://www.uscis.gov/policy-manual/volume-12-part-i-chapter-3#:~:text=General%20Eligibility%20Requirements&text=To%20be%20eligible%20for%20the,Temporary%20Protected%20Status%20(TPS)%3B There are other requirements Be between 18 and 35 Have a high school or GED or equivalent Talk to a recruiter /that is your best info available
  13. you filed in September of 2022 and it has not been a year yet in the USCIS office /expect a year before u receive a NOA2 if all documents are supplied i looked at the profile and it says local office is Seattle and i hope u did not put that office anywhere on your petition /local office is for AOS after an approved K1 / if the US office thinks u r adjusting status in the US when the interview is actually to take place in Casa, it will cost u over $500 to correct The I 130 form is used for both spouse visa and AOS our successful IR1 was 10 months in one US office and transfered to Missouri "for faster processing-a laugh) as it was another 6 months It should be a lot faster for your petition
  14. I would go back to SS office with the I 551 stamp and get a different SS officer or manager to get that SS card no reason they could not help u that will solve many issues
  15. Thinking u my live in Florida is not the same as "concrete steps to prove domcile" you need to know where u will live You need to read what USCIS considers is US domicie and the I 864 as u can not even have a joint sponsor 13. PROOF OF DOMICILE: In order to petition for your relative to come to the United States, the petitioner must have an un-relinquished residence in the United States. Please see the following pages for more information on domicile. from the above go to page 6 on the site and read Can a U.S. citizen or lawful permanent resident (LPR) petitioner who is not domiciled (residing) in the United States be a sponsor? No. The law requires a sponsor who is 1) a citizen/ national or a LPR of the United States; 2) at least 18 years of age; 3) domiciled in the United States; 4) the petitioner, and 5) meets certain income requirements. To be domiciled in the United States a sponsor must live or reside in any of the States of the United States, the District of Columbia, or any territory or possession of the United States. If the petitioner does not have a domicile in the United States, can a joint sponsor file an I-864? No. Under the law, a joint sponsor cannot sponsor an immigrant when the petitioner does not have a domicile in the United States. The petitioner must first meet all the requirements for being a sponsor, except those related to income, before there can be a joint sponsor. https://tr.usembassy.gov/wp-content/uploads/sites/91/2016/10/Instructions-for-immigrant-visa-applicants-oct-2016.pdf
  16. Form reading No , the child smuggled was not spouse, parent, son or daughter Section 212(a)(6)(E)(i) of the Act. Section 212(a)(6)(E)(iii) of the Act provides for a discretionary waiver of this ground of inadmissibility for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest, but only if the individual whom the foreign national encouraged, induced, assisted, abetted, or aided in entering the United States in violation of law was the foreign national's spouse, parent, son, or daughter (and no other individual) at the time of the offense. 17. she will need to establish that before the embassy will issue the spouse visa she can come ahead of u , get a Florida DL and send c copy to embassy https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/immigrant-visa-for-spouse.html#4 Is Residence in the U.S. Required for the U.S. Sponsor? Yes. As a U.S. sponsor/petitioner, you must maintain your principal residence (also called domicile) in the United States, which is where you plan to live for the foreseeable future. Living in the United States is required for a U.S. sponsor to file the Affidavit of Support, with few exceptions. To learn more, review the Affidavit of Support (I-864 or I-864EZ) Instructions.
  18. where do u plan to live when u come to the USA?
  19. like i said to OP and from your site An IDP must be issued in the same country as the driver’s license of the traveler. and most car rental places require us license when a student has been here 3 to 6 months depending on the state

  23. Changing last name after visa (it is attached to passport) here in the US means: I 90 to change name on green card with court order or wait for naturalization and ask for change on N 400 if she can change it on Brazilian passport before interview , i would (personal opinion)
  24. it is fraud to come to the US with intent (as u mentioned ) to adjust status and stay she needs the R-1 as she is not allowed to work/volunteer on a tourist visa
