  1. With the C1d you can work the cruise ship on your contract(s) right up to getting spouse visa and then pay the visa fee , come to US , activate the green card, enjoy a honeymoon and when the SS card comes, work with cruise ship with the I 551 stamp on visa till green card comes good thing about the spouse visa is you can work stepdaughter (USC) and her husband (Canadian) worked cruise ship(s) till their visa was approved /and they applied for her permanent residence to Canada and his green card to US / the Canadian permanent came thru 1st so they live in Canada His C1d visa did not interfer with his spouse visa petition
  2. US GOOD immigration lawyer if he can afford it Lawyer will need copy of original marriage and divorce papers for the waiver , the immigration officer will look to see if the marriage document is the same as one presented in past interview and verify document for validity i say original as PA man sent original with I 130 (back when we had to while he kept an extra for business here in US ) and the wife needed one so she got one from country register office and the clerk put a new dated stamp on it for the date she picked it up/ this caused a hassle and the PA man had to send his US original to embassy as the clerks stamp changed it/ 10 month delay just for this 2011 may be hard to still have the original I would think the CO at embassy is going to suspect your friend is visa shopping
  3. USC is the one who expedites a case and in this instance, she has no reason /women go thru pregnancy without the father a lot like when the husband is in the military Right now USCIS , is getting thousands of expedite requests
  4. https://egov.uscis.gov/processing-times/ u can check the timelines of the office doing your spouse visa
  5. that's what i said and i know many confuse it /i know people who think they are getting SSDI and it is SSI for disabled child I worked many years as PT for mentally handicapped kids and the parents were confused about the benefit
  6. The lawyer can't stop USCIS from asking any question, and can't answer the questions for you. In fact, you'll find that the lawyer has to sit quietly through much of the interview. The representative’s role is to ensure that the applicant’s legal rights are protected. A representative may advise his or her client on points of law but should not respond to questions the officer has directed to the applicant. https://www.uscis.gov/policy-manual/volume-12-part-b-chapter-3
  7. Is SSI the same as disability? if it is listed as SSI not SSDI https://www.uscis.gov/policy-manual/volume-8-part-g-chapter-5 SSI is different from our Social Security Disability Insurance (SSDI) program [^ 19] USCIS does not include income derived from the public benefits listed in 8 CFR 212.21(b): Supplemental Security Income (SSI); And it does mention SS income (if u know where to look) https://www.uscis.gov/policy-manual/volume-8-part-g-chapter-5 USCIS does not limit the consideration of income only to income that appears on federal income tax forms, and considers all evidence of income from lawful sources. Examples of income that may not appear on income tax forms include child support and alimony. Some households may also have regular income, such as Social Security income, that does not reach the minimum required threshold for filing federal income taxes.[23] USCIS also considers any evidence a noncitizen submits pertaining to expected future income. But read that site as it lists factors of the USC that help determine totality of circumstances like age, health, etc
  8. this plus if not required to file for non taxable income get the IRS letter Verification of Non-filing Letter - states that the IRS has no record of a processed Form 1040-series tax return as of the date of the request. It doesn't indicate whether you are required to file a return for that year. This letter is available after June 15 for the current tax year or anytime for the prior three tax years using Get Transcript Online or Form 4506-T. Use Form 4506-T if you need a letter for older tax years. https://www.irs.gov/individuals/transcript-types-and-ways-to-order-them
  9. Sometimes, a priority date that is current one month will not be current the next month, or the cut-off date will move backward to an earlier date. This is called visa retrogression, which occurs when more people apply for a visa in a particular category than there are visas available for that month. Visa retrogression generally occurs when the annual limit for a category or country has been exhausted or is expected to run out soon. When the new fiscal year begins on Oct. 1, a new supply of visa numbers becomes available. Usually, but not always, the new supply returns the cut-off dates to where they were before retrogression. https://www.uscis.gov/green-card/green-card-processes-and-procedures/visa-availability-and-priority-dates
  10. Again, are they staying with u? did u help them get the jobs? Do u drive them to work as they can't have a US license ? How did all this happen ? If they are with u , u need to explain they have to return and hope no one turns them in
  11. Referring to our experience MIL just in 60's MIL came on tourist visa /my husband did not bring enough of her diabetes medicine with them so we had to get a US dr and buy it here / costs of 2 prescriptions was over $500 each month she stayed BTW dr who talked Arabic was a 2 hour drive to Atlanta Bought her a cell phone and added her to my plan she spent her awake time talking to people back home //she was very homesick she was also sick to her stomach which her sister/my aunt said was normal we took her to see 8 states and meet some of my family /still very homesick she wouldn't stay even 6 months when she returned to her home , she ended up needing surgery for appendicitis costing us $1000 in morocco but imagine the cost here let them visit and don't force the green card
  12. Some states only allow 10 days for a USC to do this and GA does not transfer from state to state but Makes all take a new written and eye test it doesn't mean u have to have it within 30 days /its more like u have 30 days to do it to drive and if u can't do it within that time, u can't drive till its done
  13. OP u need to ask yourself "What is going to happen if someone reports their employer ?" if they are living with YOU? What will happen if u r stopped for traffic violation and one or both are with you and an officer wants to see ID /green card? Stay out of all this protect yourself and that includes double thinking the fiancee visa u should maybe seek a consultation with an immigrant visa attorney
  14. they are already breaking immigration laws by working on a tourist visa your fiancee has years to wait for even the green card Are they staying with u while in the US? if not, not your problem and don't offer to make it yours if they are staying with you, offer to drive them to the airport when the B visa is up Tell them this has to be legal
  15. our Moroccan friend who worked in Saudi and interviewed back home was in long AP while immigration did the security check from and Pakistan members are often in Ap (saying Refused on CEAC) while immirgration completes security checks there
  16. With one exception, a denied waiver recommendation application cannot be reconsidered or appealed, and you should not apply again under the same basis as used in your original waiver request. The one exception is if you requested a waiver based on persecution or exceptional hardship to a U.S. citizen (or legal permanent resident) spouse or child, and you have new relevant information which you believe may result in a different decision. You may apply again to USCIS. However, please be aware that you will need to submit a new waiver recommendation application, including all documents listed in Steps 1 through 3 of the Instructions, and pay the processing fee. https://travel.state.gov/content/travel/en/us-visas/study/exchange/waiver-of-the-exchange-visitor/exchange-waiver-faqs.html
  17. correct the dates as it isn't September 2023 yet so could not have recd green card 2 months from now then the VJ community with proper dates can answer
  18. Seems that in last 2 months site has been down a lot i am sure its for protection as USCIS had to check the "false hacker claim" but the CEAC site is known for updating and maintanence on weekends and especially holidays A well known hacker claimed to have breached the US Citizenship and Immigration Services (USCIS), but the US agency now says those claims are false. https://cybernews.com/security/hacker-breach-us-immigration-services/
  19. you live in Hawaii you follow the divorce laws for that state with 10 year marriage gathering common property and 2 kids, u seek a good divorce attorney
  20. https://smartdna.com.ng/immigration-dna-test/ they also have a Facebook site and video and there site allows you to call, or talk on Whatsapp or or SMS or email for info Smart DNA is a leading DNA testing centre based in Lagos, Nigeria. We provide fully accredited DNA testing service to clients in accordance with the highest international standards. Check this site as Smart (in Nigeria) allows u to schedule the DNA and promises results in 7 days this is for immigration such as UK or USA embassies require the idea a person would pay in 2019 and not have an appointment and the embassy would hang onto the case all this time is questionable 221g for additional documents are normal but the embassy would, by now, have sent the case back to US talk to the site yourself and get the facts
  21. there certainly is Standard deduction increase: The standard deduction for 2023 (which'll be useful when you file in 2024) increases to $13,850 for single filers and $27,700 for married couples filing jointly. Tax brackets increase: The income tax brackets will also increase in 2023. that's and extra $13,850 u don't pay taxes on you follow IRS site for getting the ITIN https://www.irs.gov/individuals/international-taxpayers/nonresident-spouse
  22. the Dallas lockbox address is the receiving center for the K1 visa petition it is not the USCIS office that will process the case Usually K1 is assigned to the CSC (California Service Center) When CSC receives it, you will get a WAC # and a I 791 receipt -keep this copy as u may need it later for reference Now your case sits on an inbox with thousands of other cases and Is not worked for several months u are looking at 8 months , probably more like a year till u know if CSC needs additional info or case is sent to NVC a lot of patience is needed now try to spend time with your fiancee as casa embassy likes to see quality time together allah yekbel
  23. research the cost the I 140 and cost are a lot for wife and children Family of EB-2 Visa Holders If your I-140 petition is approved, your spouse and unmarried children under the age of 21 may be eligible to apply for admission to the United States in E-21 and E-22 immigrant status, respectively. I would come on the EB visa adjust status in US to green card and apply as LPR for wife as the kids would be derivaties saving a substantial sum of money (till USCIS raises the AOS fees)
  24. each child (I 130 petition) needs its own AOS fees paid /not part of father's AOS fees father's may be stalled (or u can ask for his to coinside with the kids by sending case #'s and all names and DOB's to NVC) OR dad can fly to US get his I 551 stamp and return to fly here with the kids later BTW Nigeria has a long long waiting line and the cases could catch up
  25. The company needs to have the proper US tax ID for u to work in the US much of the company doing this depends on things like "does it sell products?" that would be competition for US companies Foreign Companies Doing Business in the United States IR Global https://irglobal.com › News › News Feb 14, 2020 — A foreign corporation may establish a branch within the US to conduct its business activities even though most foreign corporations choose ...
