  4. looked up past post and looks like u r in California There is a minimum statutory six-month waiting period before you can remarry in the state of California.
  5. your 2 names are in the system and SHOULD, if USCIS is doing their job, trigger a notice of "what's this?" RFE are quite often sent out when a name pops up that is already in the system /usually commonly used over and over type of names
  6. If you rent and his name is not on the lease OR u own and his name is not on the deed, call 911 and ask police to come help him move out your I 134 is not the same as I 864 do not help him to AOS by signing a I 864 as that binds u for 10 years He probably has Moroccn friends here that he will call for help Get a divorce attorney let him do whatever he wants to AOS on his own but without a work permit and green card , he faces a lot of issues to stay he needs u to adjust status so if u sure , u don't want to continue in marriage, don't help him in any way keep a notebook with dates and info if he threatens or worse
  7. when NOA2 is sent , the case has gone to NVC and USCIS no longer has any control or deals with it / I don't think USCIS officer can even a assess the case after it is sent out send a copy of the letter u sent to the embassy cancelling the K1 u need to write a note to embassy to let them know case #, both names and both DOB's U may get an RFE for the CR1 will match the K1 names but just respond with copy of both the original letter to USCIS and note to embassy
  8. I gather your son is in Nigeria filling out the ds 160 for the K1 this form is about the intending immigrant i can not see a sample of the form as now its online but is it wants the USC address, its her home address if it asks for USC work , she has 2 jobs and they have 2 different addresses u might watch a video on how to fill it out

  13. MY NOIR had a paragraph which read INTENT TO MARRY WAS BONA-FIDE the petition was filed (date), and has now been pending for nearly a year, please provide current bona fides of evidence to establish that (my name ) intent in marriage was to establish a life together with (my husband's name). Further evidence may include, but is not limited to comingling of finances or joint ownership of property, .......... I sent proof of joint tax returns, getting a ITIN , using ITIN to add him to bank account, getting a POA from him and adding him with a deed of our house (and in the letter I called it OUR HOUSE not MY HOUSE), added him to my water bill Additionally it said (a) proof of joint insurance policies with the other as bene (would be life insurance) and I could submit affadivits of others for statements of marriage I suggest u start to get the proof(s) u need to prove bona fide relationship by spending quality time together (( i spent months in Moroc) and think to commingle your assets as further proof OR live in spouse's country OR give it up
  14. but FBI and other agencies don't put a prioity on immigration background checks during a shutdown Shutdowns (depending on length of shutdown) do slow all down the other federal agencies and the post office if u r waiting for green card delivery
  15. i wonder if the "so called lawyers " are retired ones the way the system use to work was we applied and the interview was held in a US office to allow the person to stay or be sent home i could not find a date when that all changed/ its not even in the History of Immigration At one time there was a numerical limit on all visas per country May 1924: The Immigration Act of 1924 limits the number of immigrants allowed into the United States yearly through nationality quotas this ended in 1965 under President Johnson Interesting read https://www.history.com/topics/immigration/immigration-united-states-timeline
  16. someone should copy and paste the USCIS site for the Reddit members to read the steps for spousal visa and send it to these "lawyers" https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/immigrant-visa-for-spouse.html
  17. https://ircc-tracker-suivi.apps.cic.gc.ca/en Has this been done? Book your biometrics collection appointment as soon as you can to avoid processing delays. Find out how to give biometrics.
  18. but immigration will use it for an excuse longest shutdown was 21 days under Clinton 1995/96 U.S. Citizenship and Immigration Services (USCIS) is a fee-generating agency; accordingly, it does not rely primarily on government funding. During past shutdowns, USCIS offices generally continued to operate; however, slowdowns and processing delays can be expected due to reduced staff, particularly in instances when USCIS adjudicators rely on other government functions to render decisions.
  19. Normal white slip

    Administrative Processing Information

There are only two possible outcomes for complete and executed U.S. visa applications (absent a visa sanction against a country under Section 243(d) of the Immigration and Nationality Act). The consular officer will either issue or refuse the visa. If a visa applicant has not established that he or she is eligible for a visa, the consular officer must refuse that application. However, in accordance with Department procedures, a consular officer may determine that additional information from sources other than the applicant may help establish an applicant’s eligibility for a visa.  In such cases, refused visa applications warrant further administrative processing.

  20. Seems like we face this every year now it still would slow USCIS down many US offices are located in Federal buildings. if Congress fails its job and we have a shutdown, federal buildings are affected Immigration is funded by us who petition but embassies fall under the US budget American diplomatic establishments, embassies and consulates, are paid for by the US Government from appropriated funds. Depending upon the arrangement we have with the host country, the land is either purchased or leased, and the buildings are either built with appropriated funds or leased. Under either arrangement, the US Government pays the bills.
  21. you need to wait for the NOIR/NOID to be able to reapply and answer the issues (with actual proofs that the CO is mistaken) The following announcement makes it possible for the case to give additional evidence and prove the marriage is bona fide without going thru the long appeal process /also saves the embassy from issuing a ds5535 Sp, when USC gets the NOIR/NOID there is a chance to further send proofs of real relaitonship and marriage Announce 9/2021 In order to reduce barriers that may impede access to immigration benefits and ensure the agency is fairly and efficiently adjudicating immigration benefit requests, USCIS is returning to the principles of the 2013 policy by issuing RFEs and NOIDs when additional evidence could demonstrate eligibility for an immigration benefit. This policy will ensure that benefit requestors are given an opportunity to correct innocent mistakes and unintentional omissions and will help protect both benefit requestors and the agency from expending additional resources unnecessarily. from https://www.uscis.gov/sites/default/files/document/policy-manual-updates/20210609-RFEs%26NOIDs.pdf
  22. K1 is one time entry visa as soon as he is in US , the visa has been used This is one of the reasons spouse visa is the better choice but congratulations on your successful immigration journey
